Development shall be constructed substantially as shown on the plans and color/it-taterial board, <br />Exhibit "A", dated "Received" September 14, and November 9, 2005, on file with the Planning <br />Department, except as ~r~odifiied by the following conditions. Minor changes to the plans ir~ay be <br />allowed subject to the approval of the Planning Director it' fibund to be in substantial <br />conforn~aiicc to the approved exhibits. <br />2. The applicant shall obtain all building and other applicable City permits for the proj cct prior to <br />the commencement of construction. <br />3. The developer shall pay any and all fees to which the property may be subj eci prior to issuance <br />of building permits. The type and amount of the fees shall be those in effect at the time the <br />building permit is issued. <br />4. This design review approval shall lapse and shall become void one year from the date of <br />approval unless a building permit is issued and construction has coninienced and is diligently <br />pursued toward completion or an extension has been approved by the City_ <br />5. All conditions of approval fibr this case shall be reprinted and included as a plait sheets) with the <br />building pcnrtit plan check sets submitted For review and approval. These conditions of approval <br />shall be on, at all times, all grading and construction plans kept on the project site- <br />Ei. Prior to issuance of a building permit, the applicant shall enter into an in-lieu parking agrccrn ent <br />for three parking spaces in accordance with Municipal Code provisions to provide the Codc- <br />reyuired parking spaces for this project- The applicant shall pay the applicable in-lieu parking <br />fees prior to issuance of a building permit for the prc~ject_ <br />Prior to occ upa.ticy, the applicant shall remove the two walnut trees tree nos- 26 and 27~ and <br />construct three parking spaces in the City parking lot immediately behind (north of the subj cct <br />site, generally as shown on Exhibit C, "Staff-Recorn nzendcd Parking Lot Modification-" "1'he <br />parking lot improvements shall be shown on the plans submitted for issuance of building permits <br />
