PC-2005-41 <br />I2_C:SOLUTION APPROVING THE APPLICATION OF CL7B1X CONSTRUCTION <br />COMPANY FOR CONDITIONAL USF_ PERMIT AND DESIGN REVIEW APPRO_ VAL <br />AS FILED UNDER CASE PC7UY-133/PDR-440 <br />WHEREAS, Cubix Construction C'omparty has applied for conditional use permit and design <br />review approval to construct and operate an approximately 76,107-square-foot <br />self=storage facility on an approximately 8.37-acre site located at 5555 Sunol <br />Boulevard; and <br />WHEREAS, zoning for the property is I-P (Industrial Parks District; and <br />WHI-:REAS, at its duly noticed public hearing of August 1 O, 2005, the Planning Comn-tission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; aizd <br />WI-IEREAS, the Planning Commission adopted a Negative Declaration prepared for this <br />project; and <br />WI-IEREAS, the Platming Commission made the following findings: <br />1 . The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located- <br />Some of the objectives of the Toning ordinarice arc to: foster a harn~tonious, <br />convenient, workable relationship among land uses, protect existing land uses <br />front inharn-tonious influences and harmful intrusions, and to ensure that public <br />and private lands ultimately are used for the purposes which arc irtost appropriate <br />and benefcial to the City as a whole- The subject site. is zoned I-P (Industrial <br />Yark~ District. ~~ne pur}>o sc of the hzduslrial Park District is to provide locations <br />for uses that can operate in close proxitrtity to corrimerci al and residential uses <br />with minimum mutual adverse impact- As conditioned, the proposed self-storage <br />facility use would be consistent with the zoning ordinance objectives and <br />Industrial Yark District purpose in that it would provide a beneficial service to the <br />community and would be conducted so as to not impact or interfere with the <br />surrounding uses- "I'he applicant will -also be required to ir~i tigate any future <br />nuisances that titay occur as a result of the proposed use.
