Resolution No. 97-52 <br />Page Two <br /> <br />Section 2: Denies Case AP-97-2/UP-96-45, the application of Jerry Wagner for a <br /> conditional use permit to add an additional (33rd) mobilehome space in the <br /> Pleasanton Mobilehome Park located at 4202 Stanley Boulevard <br /> <br />Section 3: As to Space 12A, that space is one of the legal 32 spaces within the park; a <br /> different, currently unoccupied, space must be left vacant. <br /> <br />Section 4: Finds that the Park is being operated in violation of the Zoning Ordinance <br /> and directs staff to take appropriate steps, including legal action, to return <br /> the property to its legal, non-conforming status. <br /> <br />Section 5: Urges the applicant to apply (within ninety (90) days) for a General Plan <br /> amendment and PUD rezoning and development plan to legalize the park in <br /> a manner which would upgrade it and allow for the consideration of an <br /> additional (33rd) space. <br /> <br />Section 6: The City Clerk shall forward a certified copy of this resolution to the <br /> appellant with a notice that he has ninety (90) days following the date of <br /> adoption of this resolution in which to seek judicial review of this action of <br /> the City Council. <br /> <br />Section 7: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
