CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-52 <br /> <br /> RESOLUTION DENYING THE APPEAL OF JERRY <br /> WAGNER FOR A CONDITIONAL USE PERMIT TO <br /> ADD AN ADDITIONAL MOBILEHOME SPACE, AS <br /> FILED UNDER CASE AP-97-2/UP-96-45 <br /> <br />WHEREAS, Jerry Wagner, the owner of the Pleasanton Mobilehome Park, applied for a <br /> conditional use permit to add an additional (33rd) legal mobilehome space <br /> in the Pleasanton Mobilehome Park located at 4202 Stanley Boulevard; and <br /> <br />WHEREAS, zoning for the property is C-F (Freeway Commercial) District; and <br /> <br />WHEREAS, the use of the property as a mobilehome park is a legal, nonconforming use; <br /> and <br /> <br />WHEREAS, the Planning Commission determined that the appropriate findings for the <br /> expansion of the Park to 33 spaces could not be made and denied the <br /> application; and <br /> <br />WHEREAS, in the time permitted by the Municipal Code, Mr. Wagner filed a timely <br /> notice of appeal; and <br /> <br /> WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); therefore, no environmental <br /> document was prepared for this project; and <br /> <br /> WHEREAS, at its duly noticed public hearing of May 20, 1997, the City Council, <br /> considered all public testimony, relevant exhibits, and recommendations of <br /> the City staff concerning this application; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br /> Section 1: Confn'ms that the use of the property as a 32 space mobilehome park is a <br /> legal non-conforming use. <br /> <br /> <br />
