PC-2005-32 <br />RESOLUTION APPROVING THE APPLZCA"PION OF CHRIS BERATLIS AND KA7UO <br />N.ATSUSHI FOR CONDI`T'IONAL USE PERMIT AS FILED UNDER CASE PCUP-145 <br />WHEREAS, Chris Beratl is and Kazuo Hatsushi have applied for a conditional use permit to <br />allow temporary stockpiling of approximately 10,694 cubic yards of excess <br />material from 1 O Beratlis Place on to the Hatsushi nursery property located at <br />2798 Vineyard Avenue; and <br />WHEREAS, zoning for the property is PUD-LD12/OS (Planned Unit Development -Low <br />Density Residential/Open Space) District; and <br />WHEREAS, at its duly noticed public hearing of July 1 3, 2005, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommen datioizs of the <br />City staff concerning this applications and <br />WHEREAS, an environmental review for the proposed project was undertaken with the Final <br />Enviror~.rnental Impact Report ~EIR~ approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan in conformance with the standards of the <br />California Environmental Quality Act ~CEQA~; there are no substantial changes <br />to the project or to the circumstances under which the project is being undertaken <br />that involve new significant environmental effects or that substantially increase <br />the severity of~previously identified affects; furthermore, there is no new <br />information o£ substantial importance which was unknown at the time that the <br />i'inal EIR was approved by the City council regarding the prof act or its affects, <br />mitigation measures, or alternatives, any previously identi tied effects or impacts <br />arc mitigated to a level of insignificance, with the trtitigation measures <br />incorporated into the prgject's design or imposed on the prgjcct pursuant to the <br />conditions of approval; and <br />WHEREAS„ the Planning Con~ir~ission made the following rndings- <br />1 _ The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The Hatsushi property is zoned for development in conformance to the Vineyard <br />Avenue Corridor Specific Plan and is covered by a pending PUD developnicnt <br />plan. The location of the proposed grading coincides with the Specific Plan's <br />land use designations for the Hatsushi property- The conditions of approval and <br />the regulations of the Pleasanton Municipal Code give to the City the appropriate <br />
