Resolution No. PC-2005-29 <br />Page Two <br />2. The proposed location of~the conditional use a~zd the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public 1-iealth, safety, or welFarc, or materially injurious to tl-ie properties or <br />improvements in the vicinity. <br />The cabinet shop would be subject to the regulations of the City Building and Fire <br />Codas, no construction activities would take place outside of the tenant suite, and <br />all doors must remain closed when machinery is in use. Therefore, this second <br />finding can be made- <br />3. "I'he proposed conditional use will comply with each of the applicable <br />provisions o£ Chapter 7 8. 7 24 of the Pleasanton Municipal Code. <br />Chapter 1 8.124 of the Pleasanton Municipal Code states that because of their <br />unusual characteristics, conditional uses require special consideration so that they <br />may be located properly with respect to their effects on surrounding properties. <br />The recommended conditions of approval for this project will help to integrate the <br />proposed use without detrimentally affecting the s~u'rounding propcrti es and the <br />City in general. As with any use permit, this use can be suspended or revoked if <br />the conditions are not met. "Therefore, this third finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br />NOW, THEREFORE, THE PLANN1NCi COMMISSION OF "THE CITY OF PLEA SANTON <br />RESOLVES THE FOLLOWING: <br />Section 1 . Approves Case PCUP-1 44, the application of Donald Carter/Golden State <br />Cabinetry for conditional use permit to allow a 3,450-square-foot cabinetry shop <br />in the Valley Business Park PUD located at 7.065 Serpentine Lane, Suite 300, <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by re ference_ <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
