7. If the interim grading/soil transfer covered by this approval res ul.ts in conflicts or other <br />impacts to the site and/or surrounding properties, at the discretion of the Planning <br />Director, th is conditional use permit may be referred to the Planning Commission for <br />subsequent review at a public hearing. if necessary, the Plartrting Commission n-tay <br />modify or add conditions of approval to mitigate such impacts, or may revoke said <br />conditional use permit. <br />8. This conditional use permit approval will lapse within one year from the date of approval <br />unless agrading/on-site permit is issued and all measures required by the City Engineer <br />are diligently pursued toward implementation or an extension has been approved by the <br />city. <br />9_ The project developer or the property owner shall pay any and all fees to which the prop- <br />erty nay be subject prior to issuance of a» on-site/grading permit. The type and amount <br />of the fees shall be those in effect at the time the on-site/grading permit is issued~ <br />1 O. The project developer's contractor<s) shall obtain an encroachment permit from the City <br />Engineer prior to moving any construction equipment onto the site. <br />1 1 . The haul route for all materials to and from this development shall be approved by the <br />City Engineer prior to the issuance of a grading/encroachment perrrtit. <br />12. Any damage to existing street itriprovements during the grading and/or transfer of dirt <br />material on/from the subject property shall be repaired to the satisfaction of the City <br />Engineer at full expense to the project developer. This shall include slurry seal, overlay, <br />or street reconstruction if deemed warranted by the City Engineer~ <br />1 3. The project developer shall submit a dust control plan or procedure as part of the grading <br />plans. <br />7 4. All on-site/grading plans must comply with all codes and ordinances in effc ct bcforc the <br />Building Department will issue permits. <br />15. The project developer shall comply with the Alameda Countywide NPDES Permit <br />#C7A50029831, a copy of which is available at the City offices. <br />l6_ The prof ec.t dc.vc-loper shall submit a trafFc control plan for the hauling ol~e;ration <br />crossing Old Vineyard Avenue to the City Engineer for review and approval bcforc <br />issuance of a grading permit- <br />17. Prior to starting grading, the project developer shall install a construction fence <br />acceptable to the City Engineer to prevent construction debris tYon~ entering the creek to <br />the south of the grading operation. The fence location and design shall be shown on the <br />grading plans for review and approval by the City Engineer before issuai~ce of a grading <br />permit. <br />2 <br />
