The interim grading/soil transfer shall substantially conform to the development plaits, <br />)=.xhibit A, dated "i2aceivad May 16, 2005" on file with the Planning Department, except <br />as modified by the iollowing conditions_ Minor changes to the plans may be allowed <br />subject to the approval of the Planning Director if found to be in substantial conformance <br />to the approved exhibits_ <br />2. All conditions of Case PUD-OS and Vesting Tentative Subdivision Map 7399 shall <br />remain in full force and effect. <br />3. The project developer shall obtain a Grading Permit from the Engineering Division, <br />Public Works DeparUr~ent and atty other applicable City pex-~riits for the project prior to <br />the commencement of any construction. <br />4. The project developer shall submit a tinal grading and drainage plan for the interim <br />grading/transfer, prepared by a licensed civil engineer, depicting all final grades and on- <br />site drainage control measures to protect all cut and fill slopes from surface water <br />overflow_ 'This plan shall be subject to the review and approval of the City Engineer <br />prior to the issuance of any building permits_ <br />5. No trees shall be removed other than those specifically designated for removal on the <br />approved plans for PUD-OS and Vesting Tentative Subdivision M.ap 7399. F3efo re the <br />on-site/grading permit is issued, the project developer shall show all existing trees on <br />and/or within 50 feet of the work to be done and shall state on the plans the trees to be <br />preserved. The project developer shall then post cash, letter of credit, or other security <br />satisfactory to the Planning [Jirect~r in the amount of $5,000 for each tree to be <br />preserved, up to a maximum of $25,000. This City shall retain the cash bond or security <br />for one year following the completion of the interim grading, or one year after the final <br />subdivision grading of Tract 7399 is completed if the final subdivision grading is started <br />within a 12-month period following the interim grading covered by this approval, and <br />shall be forfeited if the trees to be preserved are destroyed or substantially darnagcd. <br />F>_ All conditions of approval for this conditional use permit shall he reprinted and included <br />as a plan sheet~s~ with the on-site/grading permit plan check sets submitted for review <br />and approval_ These conditions of approval shall be on, at all times, all grading and <br />construction plans kept on the project site. It is the responsibility of the project developer <br />or the property owner to ensure that the conditions of approval are implemented. Prior <br />approval from the Planning Department must be received before any changes are <br />constituted in design, location, erosion control measures, etc. <br />
