Therefore, this first finding can be made- <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br />The off-haul material will be used to grade an adjoining site in conformance to its <br />development plan and subdivision map approvals. Transferring this surplus to the <br />Hahner property, an adjoining site, from a local source would make efficient use <br />of this resource- It would reduce the off-haul from this site by 40,000 cubic yards, <br />estixnatcd to equal 2,000 to 4,000 round-trip truck trips, which would elirrxinate <br />the need to import the needed Till material to the Hahner site from an outside <br />source- In addition, the transfer would occur entirely between these two sites off <br />City streets. Therefore, this Finding can be made. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinarxce. <br />The grading would implement the applicable urban stormwater runoff and erosion <br />control measures so as to be compatible with the sut~ject property and with <br />surrounding properties- As conditioned, if problems were to arise with the <br />grading and transfer, the City can review the conditional use permit ai a public <br />hearing and require additional conditions to correct the problem. Therefore, this <br />finding can be made. <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the ar~a~ <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASAN TON <br />RESOLVES THE FOLLOWING: <br />Section 1 . Approves Case PCUP-142, the application of Frank and Barbara Berlogar for <br />conditional use permit approval to allow interim grading of the Berlogar portion <br />of PUD-OS to transfer approximately 40,000 cubic yards of excess earth (off-haul <br />to meet the fill material needs of PUD-O1 (Hahner~ located at 2287 Vineyard <br />Avenue, subject to the conditions shown in Exhibit "B," attached hereto and made <br />part of this case by reference. <br />Section 2. This resolution shall become effective ] 5 days after its passage and adoption <br />unless appealed prior to that time- <br />
