PLANNING COMMISSION CITY OF PLEASANTON <br />A LAMEDA C:CU LINTY, CALLFORNIA <br />RESOLUTION NO. PC-2005-25 <br />I2_ESOLUTION APPROVING TI-IE APPLICATION OF FRANK AND BARBARA <br />BERLOGAR FOR CONDITIONAL USE PERMIT AS FILED UNDER CASE PCUP-142 <br />WHEREAS, Frank and Barbara Berlogar has applied for conditional use permit to allow <br />i nierim grading of the Bcrlogar portion of PUD-OS to transfer approximately <br />40,000 cubic yards of excess earth doff-hauls to meet the fill material needs of <br />PUD-O1 (Ilahner~ located at 2287 Vineyard Avenue; and <br />WHEREAS, zoning for the property is PUD-LDR <Planned Unit Development -Low Density <br />Residential) District; and <br />WHEREAS, at its duly noticed public hearing of June 8, 2005, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations or the <br />City staff concerning this application; and <br />WHEREAS, an environmental review for the proposed project was undertaken with the Final <br />Environmental Impact Report ~EIR~ approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan in conformance with the standards of the <br />California Environmental Quality Act ~CEQA~; there are no substantial changes <br />to the project or to the circumstances under which the project is being undertaken <br />that involve new significant enviror~inental effect or that substantially increase the <br />severity of previously identified effects; furthermore, there is no new information <br />of substantial importance which was unknown at the time that the Final EIR was <br />approved by the City Council regarding the project or its effects, mitigation <br />measures, or alternatives; any previously identiF ed effects or impacts arc <br />mitigated to a level of insignificance, with the mitigation measures incorporated <br />into the project's design or imposed on the project pursuant to the conditions of <br />approval; therefore, no new environmental document accompanies this <br />application; and <br />WHEREAS, the Plaruiing Commission made the following findings= <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located- <br />"hhe Berlogar property is zoned for development "I']ze location of the proposed <br />grading coincides with the YUD development plan and subdivision map <br />approvals. The conditions of approval and the regulations of the Pleasanton <br />Municipal Code give to the City the appropriate controls to ensure that the <br />
