EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PDR-441 ~ Gene Finch <br />312 St_ Mary Street <br />February 23, 200_S <br />General Conditions. <br />1. Development shall be substantially as shown on the development plans and color board, <br />Exhibit "A", dated "Received" February 9, 2005, on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br />2. Design review approval shall lapse within one (1 J year from the date o£ approval unless a <br />building permit is issued and construction has commenced and is diligently pursued <br />toward completion, or an extension has been approved by the City pursuant to Section <br />1 8.20.070 of the Municipal Code. <br />3. The applicant shall obtain a building permit, and any other applicable City permits for the <br />project prior to the commencement o£any construction. <br />4. The project developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. The type and amount of the fees shall be those in <br />effect at the time the building permit is issued- <br />5. Prior to issuance of a building permit, the applicant shall obtain and record an easement <br />from the adjacent property owner of 641 Main Street and 328/336 St_ Mary St. for <br />emergency egress from the proposed bedroom window- "1'he language of said easement <br />shall be subject to the review and approval by the City Attorney prior to recordation. In <br />addition, any existing or future gates within the walkway/alley between the proposed <br />bedroom window and St. Mary Street and/or the public parking lot behind 328/336 St. <br />Mary Street shall be modified/designed to comply with the applicable Building Code <br />egress requirements to the satisfaction of the Chief Building Olficial_ <br />6. Details and sections of the balcony, windows and window treatments (sill, trim, frame, <br />sash, mullion, window recess, etc-), doors, and building trim, shall be shown on the <br />building permit plans and shall he subject to review and approval by the Planning <br />Director prior to issuance of a building permit. The design and materials of these <br />elements shall be compatible with the building architecture and comply with the <br />Downtown Design Guidelir~es. <br />1 <br />
