PLANNING COMMISSION CITY OF PLEASANTON <br />AI_AMEI~A COUNTY, C'ALiFORNIA <br />RESOLUTION NO_ PC-2005-09 <br />RESOLUTION MODIFYING TFiE UNION JACK PUS USE PERMIT, <br />AS FILED UNDER CASE UP-88-7 7 <br />WHEREAS, the City of Pleasanton initiated the review and consideration of possible rnoditication toy <br />or revocation of, an approved conditional use permit for the Union Jack Pub located at <br />725 Main Street to operate a restaurant/bar where alcohol is screed after ] 0:00 p.m.; and <br />WHEREAS, zo ning for the property is C-C (Central Commercial), Downtown Revitalization, Core <br />Uverlay District; and <br />WHEREAS, at its duly noticed public hearing of T'ebruary 23, 2005, the Planning Con~niission <br />considered all public testimony, relevant exhibits, and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, n~odi [ications to existing use permits are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA~; and <br />WHEREAS, the Planning Commission made the I<~llowing findings: <br />As modified, the location of the conditional use is in accordance with the <br />objectives of the zoning ordiiia.nce and the purpose of the district in which the site <br />is located. <br />The subject site is located in the Central Co~r~mercial t;C-CJ zoning, Downtown <br />Revitalization and Core Overlay District. One of the purposes of the C District is to <br />provide opportunities for, and concentration of, service and an-iusement establishments <br />that have mutually beneficial relationships with one another for the convenience and <br />enjoyment of the public. Although the pub has caused problems in the Downtown area, <br />with added and amended conditions, the use should once again be appropriate in this <br />location. Therefore, this finding can be niade_ <br />2. As modified, the proposed location of the conditional use and the conditions <br />under which the conditional use would be operated or maintained. will nol be <br />detrimental to the public health, safety, or welfare, or materially injurious to the <br />properties or improvements in the vicinity. <br />With amended and added conditions, the restaurant would not have an adverse effect on <br />any surrounding properties- "Phis is subject to the ownership complying with the: <br />conditions and monitoring to ensure that the conditions are being implemented. <br />Therefore, this findi»g caxi be made- <br />
