Resolution No. 97-43 <br />Page Two <br /> <br />WHEREAS, the Alameda County Mayors' Conference, the City of Pleasanton <br /> (Resolution No. 80-74) and the Alameda County Board of Supervisors <br /> (Resolution No. 186574) have agreed to a method for equitably distributing <br /> the property taxes; and <br /> <br />WHEREAS, such specific annexation needs a resolution from both the City and County <br /> agreeing to the exchange of property tax revenues for the annexation to be <br /> completed and filed with the State; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The Local Agency Formation Commission of Alameda County is hereby <br /> requested to take proceedings for the annexation of territory as described in <br /> Exhibit "A", according to the terms and conditions stated above and in the <br /> manner provided by the Cortese-Knox Local Government Reorganization <br /> Act of 1985. <br /> <br /> Section 2: That for Annexation No. 142 by the City of Pleasanton, which will be fffst <br /> effective for the fiscal year following the filing of the Certificate of <br /> Completion with the State Board of Equalization providing the filing occurs <br /> prior to December 31 of the preceding year, the Auditor-Controller of the <br /> County of Alameda shall be directed to cause an exchange of property tax <br /> revenues pursuant to the provisions of paragraphs No. 1 and 3 of the <br /> attached City/County agreement.' <br /> <br />Section 3: That City certifies that: <br /> <br /> There is no commercial and/or industrial development in the proposed <br /> annexation. <br /> <br /> Section 4: That the property tax proceeds accruing for the Structural Fire Fund shall <br /> be transferred to the City of Pleasanton. <br /> <br /> Section 5: This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> <br /> <br />
