CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 97-43 <br /> <br /> RESOLUTION OF APPLICATION BY THE CITY OF <br /> PLEASANTON REQUESTING THE LOCAL AGENCY <br /> FORMATION COMMISSION TO TAKE <br /> PROCEEDINGS FOR THE PROPOSED ANNEXATION <br /> NO. 142 PURSUANT TO THE CORTESE-KNOX <br /> LOCAL GOVERNMENT REORGANIZATION ACT OF <br /> 1985 AND AGREEING TO THE EXCHANGE OF <br /> PROPERTY TAX REVENUE FOR ANNEXATION NO. <br /> 142 <br /> <br />WHEREAS, the City of Pleasanton desires to initiate proceedings pursuant to the <br /> Cortese-Knox Local Government Reorganization Act of 1985, Division 3, <br /> commencing with Section 56000 of the California Government Code, for <br /> the annexation of approximately 37.64 acres, Annexation No. 142 and <br /> requests initiation of proceedings thereon; and <br /> <br />WHEREAS, the territory proposed to be annexed is inhabited, and a description of the <br /> boundaries of the territory is set forth in Exhibit "A", attached hereto and <br /> by this reference incorporated herein; and <br /> <br />WHEREAS, protests from 50% of the property owners have not been received; and <br /> <br />WHEREAS, this proposal is consistent with the sphere of influence of the affected city; <br /> <br />WHEREAS, the reasons for this proposed annexation are as follows: <br /> <br /> This is a logical extension of the City limits and the City of Pleasanton <br /> should have control over the development of this property. <br /> <br />WHEREAS, Section 99 of the Revenue and Taxation Code (AB 8) provides, among <br /> other things, that no local agency jurisdictional change can be completed <br /> without the agencies affected by such change first having agreed upon an <br /> exchange of property tax revenue between and among the affected agencies; <br /> and <br /> <br /> <br />
