PRINCIPLES OF AGREEMENT <br /> for <br /> LAVWMA EXPANSION PROJECT <br /> <br />The three undersigned. following extensive discussions with assistance of their staffs. have prepared <br />the following proposal to resolve current controversies involving the LAVWMA member agencies. <br />The undersigned will promptly submit these principles to the LAVW'MA Board at the April meeting <br />for discussion and request the LAVW'MA Board to refer these principles to the member agencies for <br />consideration at their earliest opportunity. At the following LAVWMA Board meeting, staff and <br />legal counsel will present a schedule for implementing the key steps in these principles. <br /> <br />A. LAVWMA Wastewater Treatment and Disposal Principles <br /> <br /> 1. Establish a raw wastewater infiuent limit to all existing and future wastewater <br /> treatment facilities in the Valley of 3 1.8 mgd ADWY. The influent limit shall be <br /> allocated as follows: Livermore 1 I. 1 mgd; Pleasanton 10.3 mgd; and DSRSD 10.4 <br /> mgd. <br /> <br /> 2. The infiuent limit will be in perpetuity unless modified by unanimous agreement of <br /> the member agencies. A member agency will not issue connections if the agency's <br /> infiuent limit has been reached. Other member agencies may enforce compliance <br /> with the influent ILmit. Two member agencies may transfer between them a portion <br /> of their allocation upon mutual agreement. <br /> <br /> 3. The parties shall install a system for infiuent metering for each member agency at the <br /> wastewater plants that is agreeable to the three parties. <br /> <br /> 4. The member agencies shall provide wastewater treatment and disposal services only <br /> to areas which are currently served by a member agency, or to current and future <br /> incorporated areas within the cities of Livermore, Pleasanton. Dublin and the portion <br /> of San Ramon currently served, plus west side expansion. Member agencies may <br /> provide services to small unincorporated properties adjacent to the cities in the <br /> interest of protecting public health and safety.. If the property in an unincorporated <br /> geographic area exceeds the equivalent of 10 residential connections, service will <br /> require unanimous approval of the member agencies; provided, however, a member <br /> agency may continue to provide service to unincorporated geographic axeas which <br /> the member agency currently serves. Livemore may provide wastewater treatment <br /> and disposal service to residents in the unincorporated agricultural mitigation area <br /> in North Livermore, the VA hospital and the immediate area around the VA hospital. <br /> DSKSD may provide wastewater treatment and disposal services to Camp Parks for <br /> federal uses and to the County Jail for County institutional uses. The other <br /> geographical limitations in the Second Modification shall be cart'led forward. No <br /> other areas may be served by a member agency without the unanimous approval of <br /> the member agencies. The member agencies will, individually and collectively, <br /> actively resist any other governmental agency requiring service outside the areas <br /> described herein. <br /> <br /> 04110/97 <br /> <br /> <br />
