<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />RESOLUTION NO. 06- <br /> <br />RESOLUTION AMENDING MASTER FEE RESOLUTION NO. 92-100 TO <br />ADD THE VINEYARD AVENUE AGRICULTURAL MITIGATION FEE <br /> <br />WHEREAS, on May 19, 1992, the City Council adopted Resolution No. 92-100 that established <br />a new Master Fee Schedule; and <br /> <br />WHEREAS, the City adopted the Vineyard Avenue Corridor Specific Plan ("Specific Plan") on <br />June 1, 1999; and <br /> <br />WHEREAS, pursuant to the Specific Plan, certain property owners are required to pay an <br />agricultural mitigation fee to the City prior to their properties' development to ensure that <br />development in the Vineyard Avenue Corridor compensates for the loss of cultivable or <br />potentially cultivable soils through a payment to fund the Tri-Valley Conservancy's <br />conservation efforts; and <br /> <br />WHEREAS, the Specific Plan states that the amount ofthe agricultural mitigation fee is based <br />on a "one-to-one ratio between the cost per acre for agricultural easements to the Trust [Tri- <br />Valley Conservancy] and the net acreage of potentially cultivable soils less than 25 percent in <br />slope lost to development"; and <br /> <br />WHEREAS, the Tri-Valley Conservancy has provided the City with an appraisal that shows that <br />the value of an agricultural conservation easement is $25,000 per acre. <br /> <br />WHEREAS, in addition to the cost of the easement, City staff expends time to review, collect <br />and distribute the fee, calculated at a flat amount of$645; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council amends the Master Fee Resolution No. 92-100 by revising Section <br />IX, Development Impact Fees to include the following subsection (I): <br /> <br />I. Vineyard Avenue Agricultural Mitigation Fee applicable to those properties <br />identified in the Vineyard Avenue Corridor Specific Plan (Lots 18-28,32 <br />and 33) is the sum of: <br />
