AGREEMENT FOR COLLECTION OF AGRlCUL TURAL MITIGATION FEE (Vineyard Avenue Corridor) THIS AGREEMENT is entered into this _ day of , 2006 between the City of Pleasant on ("City") and the Tri-Valley Conservancy, a California nonprofit public benefit corporation ("TVC"). RECITALS A. Pursuant to the City's Vineyard Avenue Corridor Specific Plan ("Specific Plan") adopted on June 1, 1999, certain property owners are required to pay an agricultural mitigation fee to the City for distribution to TVC prior to their properties' development. B. The Specific Plan states that the agricultural mitigation fee is based on a "one-to- one ratio between the cost per acre for agricultural easements to the Trust [TVC] and the net acreage of potentially cultivable soils less than 25 percent in slope lost to development." C. The parties desire to set forth procedures for collecting, distributing and using the agricultural mitigation fee. NOW, THEREFORE, in consideration of the mutual covenants and conditions in this Agreement, City and TVC agree as follows: 1. City's Oblil!ations. City shall take all necessary actions to: a. Consider an agricultural mitigation fee in accordance with the Specific Plan, including a portion to cover costs of the City's administration of the fee (collectively "Fee") for inclusion in the City's master fee schedule. b. Consider changes to the Fee to ensure the Fee reflects the current cost of agricultural conservation easements, following notification and receipt of supporting documentation from TVC that the appraised cost per acre for agricultural easements has changed. c. For development subject to the Fee, include as a condition of project approval the payment of the Fee prior to recordation of the first final map for the development. d. Require property owners/developers subject to the Fee to provide a diagram showing the areas of potentially cultivable soils containing less than 25 percent in slope that will no longer be available for agriculture as a result of the development, and forward that diagram to the TVC for comment prior to approving the recordation of a subdivision map for development purposes under the Specific Plan. The City shall determine the amount of acres subject to the Fee, with consultation and input from TVC. e. Approve a final map for development subject to the Fee only after City has received payment of the Fee.
