<br />AGREEMENT FOR COLLECTION OF AGRlCUL TURAL MITIGATION FEE <br />(Vineyard Avenue Corridor) <br /> <br />THIS AGREEMENT is entered into this _ day of , 2006 between the <br />City of Pleasant on ("City") and the Tri-Valley Conservancy, a California nonprofit public <br />benefit corporation ("TVC"). <br /> <br />RECITALS <br /> <br />A. Pursuant to the City's Vineyard Avenue Corridor Specific Plan ("Specific Plan") <br />adopted on June 1, 1999, certain property owners are required to pay an agricultural mitigation <br />fee to the City for distribution to TVC prior to their properties' development. <br /> <br />B. The Specific Plan states that the agricultural mitigation fee is based on a "one-to- <br />one ratio between the cost per acre for agricultural easements to the Trust [TVC] and the net <br />acreage of potentially cultivable soils less than 25 percent in slope lost to development." <br /> <br />C. The parties desire to set forth procedures for collecting, distributing and using the <br />agricultural mitigation fee. <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants and conditions in this <br />Agreement, City and TVC agree as follows: <br /> <br />1. City's Oblil!ations. City shall take all necessary actions to: <br /> <br />a. Consider an agricultural mitigation fee in accordance with the Specific <br />Plan, including a portion to cover costs of the City's administration of the fee (collectively <br />"Fee") for inclusion in the City's master fee schedule. <br /> <br />b. Consider changes to the Fee to ensure the Fee reflects the current cost of <br />agricultural conservation easements, following notification and receipt of supporting <br />documentation from TVC that the appraised cost per acre for agricultural easements has <br />changed. <br /> <br />c. For development subject to the Fee, include as a condition of project <br />approval the payment of the Fee prior to recordation of the first final map for the development. <br /> <br />d. Require property owners/developers subject to the Fee to provide a <br />diagram showing the areas of potentially cultivable soils containing less than 25 percent in slope <br />that will no longer be available for agriculture as a result of the development, and forward that <br />diagram to the TVC for comment prior to approving the recordation of a subdivision map for <br />development purposes under the Specific Plan. The City shall determine the amount of acres <br />subject to the Fee, with consultation and input from TVC. <br /> <br />e. Approve a final map for development subject to the Fee only after City <br />has received payment of the Fee. <br />
