<br />Safety <br /> <br />Per the PMC, "Large family daycare homes shall meet all regulations of the state fire marshal <br />adopted as part of the California Administrative Code and relating specifically to large family <br />daycare homes." (Ord. 112699, 1984; Prior Code 92-11.20(c)). <br /> <br />The Fire Department, Child Care Links, and the Alameda County Child Care Licensing <br />Department have not identified any safety concerns regarding this project, and staff feels that the <br />condition of approval for the applicant to receive the proper signoffs from the Fire Department <br />satisfies this finding. <br /> <br />Additionally, the applicant is required by the California Health and Safety Code to provide <br />insurance in the amount of $1 00,000 per occupant for injury to clients and guests and either <br />insurance or a bond in the amount of $300,000 (total annual aggregate) for negligence on behalf <br />of the licensee or its employees. The insurance would hold the HOA harmless should the <br />children be injured while in the common area. The State Department of Social Services-CCL <br />also requires this insurance to be in place prior to operation. The applicant has stated that the <br />required insurance has been obtained. <br /> <br />PUBLIC COMMENT <br /> <br />Notices of the revised project description were sent to the residents within a 1,000-foot radius of <br />the subject property on November 29,2005. The notice included the letter submitted by the <br />applicant requesting the revision. Following the distribution of the revised project notice, notices <br />for the City Council hearing were sent to the residents within a I,OOO-foot radius of the subject <br />property. <br /> <br />To date, staff has received three (3) e-mails and 14 phone calls in response to the recent noticing <br />expressing opposition to a large family daycare at the proposed location even with the reduced <br />number of children being requested. Additionally, the respondents stated that the applicant is not <br />correctly reporting the parking spaces available and the events that took place at the annual HOA <br />meeting. Summarized comments are attached. <br /> <br />In addition to direct communication with the City, staff has received documentation/petitions <br />both in opposition and in support of the application. The applicant has provided a petition of <br />support for the expansion of the daycare. The petition contains 59 signatures of persons residing <br />within and outside of the City of Pleasant on. The neighborhood previously submitted a report <br />that outlines the areas of concern and includes 79 signatures of persons residing within the <br />neighborhood and neighborhoods within close proximity of the project site. The petition of <br />support is included in this staff report as Attachment 5, Exhibit E, and the neighborhood report is <br />included in the Planning Commission Staff Report as Attachment II, Exhibit K. <br /> <br />SR:06:033 <br />Page 9 <br />
