No. 4-ll79-c will automatically be vested in STATE, and all materials, equip- ment and appurtenances installed outside of STATE's right of way will automatically be vested in CITY. All traffic signals and safety lighting, materials, equipment, and appurtenances in- stalled on PROJECT shall be owned by STATE regardless of the lo- cation of the installation except for the TI-70 controllers which will be owned, operated and maintained by CITY as stated in Sec- tion (I) Article (16) and no further agreement will be necessary to transfer ownership as stated herein above. (13) Nothing in the provisions of this Agreement is in- tended to create duties or obligations to or rights in third par- ties not parties to this contract, or affect the legal liability of either party to the contract, by imposing any standard of care respecting the maintenance of State highways different from the standard of care imposed by law. (14) CITY may, at its sole option and in accordance with Article (2) of Section I, retain one or more consultants to perform services pursuant to Article (1) of Section I or adminis- ter the construction contract for PROJECT. (15) CITY and CITY'S construction contractor (and con- struction engineering consultants, if any) shall maintain in force, until completion and acceptance of the PROJECT con- struction contract, a policy of Contractual Liability Insurance, including coverage of Bodily Injury Liability and Property Damage Liability with limits of not less than those specified in Section 7-1.12 of STATE's Standard Specifications.
