<br />. <br /> <br />. <br />EXHIBIT <br /> <br />Foct 17, 2005 <br /> <br />City of Pleasanton Planning Commission <br />Pleasanton, California <br /> <br />Dear Commission Member: <br /> <br />We are neighbors of Mr. Heinrich Fischer who is seeking an amendment to City <br />Ordinance No. 1192 (Zoning Unit No. 308) Site Development Standards for' <br />Rosepark Duets (pg 2, item 3) to allow his backyard awning. Mr. Fischer's request <br />is supported by the City's planning staff, apparently because the staff believes <br />awnings are no different from wood patio covers, which Rosepark HOA development <br />standards allow. We disagree. While wood patio covers and awnings serve the <br />same purpose, visually they are very different. We constructed a redwood patio <br />deck and redwood patio cover when we moved to Rosepark in 1989. The deck and <br />patio cover were constructed in accordance with Rosepark Architectural Guidelines <br />and setback requirements. These improvements were inspected and approved by <br />the Rosepark Architectural Committee. Mr. Fischer's backyard awning is a 12' x 12' <br />solid dark green canvas that was installed on our adjoining fence line. <br /> <br />We ask the Commission to deny the requested change to Rosepark Site <br />Development Standards for the following reasons: <br /> <br />1. Visually, the large awning is not an attractive improvement. <br /> <br />2. We understand that most Pleasanton HOAs do not permit awnings. <br /> <br />3. Most homeowner improvements in the city are required to meet specific <br />setback requirements. <br /> <br />4. The HOA Board reviewed Mr. Fischer's request for the awning and <br />unanimously rejected it, twice. <br /> <br />5.
