<br />Honorable Mayor and Mernbers of the City Council: <br /> <br />BACKGROUND <br /> <br />Heinrich Fischer submitted an application for a Hlodification to an approved Planned Unit <br />Developnlent (PUD) to allo~ a retractable canvas a""ning installed to the rear of the existing <br />homeo As originally approved, the uses and sitc development standards of the paired single- <br />family residential portion of the Charter Oaks Development ""ere those of the RM-4,000 District. <br />On July 28, 1988, the City approved a minor modification to the PUD revising the site <br />development standards for the complex to allo~ construction of decks, acccssory structures, and <br />patio covers closer to the property line than the approved RM-4,000 development standardso The <br />revised standards, ~hich are similar to those approved for other small lot subdivisions located in <br />the City, do not allo~ "architectural projections such as a~nings, eaves, etco" <br /> <br />Due to opposition to the a~ning from both a neighbor and the Rosepark Homeo~ners <br />Association (HOA), the application became a major modification to the PUDo As ~ith all PUD <br />major modifications, this application is subject to revie~ and recommendation by the Planning <br />Commission and to revie~ and final action by the City Council. By a 4 to I vote, the Planning <br />Commission recommended denial of the proposed PUD modification to allo~ the retractable <br />canvas a~ningo <br /> <br />SITE DESCRIPTION <br /> <br />The subject site is an approximately 4,731 square-foot lot located on Poppybank Court ~ith a <br />roughly 1,772 square-foot rear yard area. The site is bordered on all sides by paired single-family <br />residential properties (please refer to the location map)o <br /> <br />PROJECT DESCRIPTION <br /> <br />The applicant requests a modification to the Charter Oaks Paired Single-Family PUD to allo~ a <br />retractable green canvas a~ning at the rear of his homeo The canvas a""ning, ""hen fully <br />extended, is approximately 7 feet 9 inches (7' 9") high, II feet 3 inches (I I ' 3") ~ide and 9 feet <br />2 inches (9' 2") longo At full extension it retains an approximately 15 feet 4 inches (15' 4") rear <br />yard setback and an approximately 0' side yard setback to the zero-lot property lineo Please refer <br />to the site plans in Exhibit Ao The applicant has agreed to maintain the a""ning such that it is in a <br />good condition at all timeso Staff has added recommended condition of approval to address thiso <br /> <br />SR 06:020 <br />Page 2 of6 <br />
