I am the Community Association Manager tor Rosepark <br />Homeo"Wners Association (HOA) in Pleasanton, Ca. and am "Writing to you on behalt 01 <br />the Board 01 Directors 01the Rosepark HOA. <br /> <br />This is regarding the planned "Waiver request 010rdinance 1 192, section PUD-85-1-3M <br />on behal101Mr. Heinrich Fischer 01 1576 Poppybank Court in Pleasanton. Mr. Fischer <br />is a member otRosepark HOA. <br /> <br />Initially Mr. Fischer installed this a"Wning "Without the approval 01the Board otDirectors <br />otRosepark HOA as specified in the community's Covenants, Conditions and <br />Restrictions (CC&Rs) and Architectural Guidelines or the City 01 Pleasanton Planning <br />Commission. I believe it "Was installed during the summer 012004, although I personally <br />have no kno"Wledge as to "When the a"Wning "Was installed. Mr. Fischer requested approval <br />01 the already installed a"Wning 1rom the Rosepark HOA Board 01 Directors on August <br />27,2004. Due to the meeting schedule and lack 01 quorum his request "Was presented to <br />the Board 01 Directors at the November 8, 2004 meeting. At this meeting Mr. Fischer's <br />next door neighbor raised the a"Wning issue during the homeo"Wners open 10rum. She <br />objected to Mr. Fischer's installation 01 the a"Wning, not only in accordance "With <br />ordinance] ] 92, section PUD-85-] -3M, but also the a"Wning did not have a 5 ft. setback <br />from the property line specified by the HOA's Architectural Guidelines. Additionally, <br />she "Was concemed that "When the a"Wning "Was tully extended that the "Width 01 the a"Wning <br />W'ould encroach on her property line. Presented "With these 1acts the Board 01 Directors <br />denied his request and he "Was requested to make arrangements to have the a"Wning <br />removed as soon as possible. Mr. Fischer "Was in10rmed by telephone shortly thereafler <br />and "Was sent "Written confirmation. <br /> <br />He requested that the Board 01 Directors reconsider this request and it be re-presented to <br />the Board 01 Directors and again due to meeting schedul ing and lack 01 quorum it W'as re- <br />presented to the Board 01 Directors at the scheduled Board 01 Director meeting in July 01 <br />2005, along "With a letter tron"! the City 01 Pleasanton planning cornmission stating that <br />they W'ould request the City Council "Waive the a"Wning stipulation stated in ordinance <br />
