To <br />the fullest extent possible, student enrollment is verified through the district offices. <br />Historically, the ridematching database vvas created and managed by a third-party administrator. <br /> <br />Waiver of Claims and Indemnification Agreement <br /> <br />MTC contracts vvith Parsons Brinckerhoff (Consultant) to operate the 511 Regional Rideshare <br />Program (RRP). The goal of the RRP is to reduce auto emissions and mitigate traffic congestion <br />region-vvide by initiating and sustaining quantifiable modal shifts from single occupant vehicles <br />(SOV) trips to carpools and vanpools and by initiating and sustaining quantifiable employer <br />transportation demand management programs. <br /> <br />The RRP provides a Ridematching System (RMS), both Web-based and manual, to form <br />carpools and vanpools. Historically, the RRP has not provided a formal "SchoolPool" matching <br />program to support carpooling to and from K-12 school sites, although any member of the <br />public could use the RMS for that purpose, if he/she vvanted. The RRP has not formalized <br />SchoolPool matching. <br /> <br />Over the past several years some counties, cities, tovvns, school districts, and individual schools <br />have targeted the reduction of vehicle trips at K-12 school sites. While the RRP is not in the <br />position to actively promote SchoolPooling, MTC is able to offer the RRP's Ridematching <br />System as a tool to support those counties, cities, tovvns, school districts and schools that vvant to <br />use it. <br /> <br />To accommodate the SchoolPool matching program, the RRP Consultant has established the <br />attached "Procedures for Using Ridematching System (RMS) for SchoolPool Programs." <br /> <br />The administering agency (i.e., county, county congestion management agency (CMA), city, <br />tovvn, school district or school) is required to enter into an agreement vvith MTC to: (1) vvaive <br />any and all claims against MTC for any loss, liability or damages resulting from its use of the <br />RRP's RMS for SchoolPool matching; and (2) indemnifY, hold harmless, and defend MTC <br />against any and all third party claims that may result from the agency's participation in, or <br />support of, SchoolPool. The agreement vvill be valid for up to a one-year period consistent vvith <br />the school's academic years and this kind of vvaiver is consistent vvith other agreements the City <br />has vvith service providers. <br /> <br />DISCUSSION <br /> <br />If the Agreement is approved, the City vvill novv be allovved to create and maintain its ovvn <br />database through an agreement vvith the Metropolitan Transportation Commission vvith softvvare <br />provided by its consultant, Parsons Brinckerhoff.
