<br />100 Insurance. <br /> <br />ao General Commercial Liability Insurance 0 It is further agreed that Lessee ~ill <br />name the City, members of the City Council, its agents, officers and employees as additional <br />insureds ~ith respect to liability resulting from the use of the Property by Lessee and the conduct <br />of Lessee's activities at the Property and Facilityo Lessee agrees to deliver to the City, upon <br />execution of this Agreement, a Certificate of Insurance, satisfactory in form to the City Attomey, <br />sho~ing that Lessee has obtained a continuing commercial general liability policy of insurance <br />in the amount not less than $1,000,000 per claim, providing for ten (10) days' notice to City prior <br />to cancellation and shall keep same enforced during the term of this Agreemento <br /> <br />b. Workers' Compensation Insuranceo Lessee shall also provide evidence of <br />~orkers' compensation insurance for any employees of Lessee as required by la~. <br /> <br />c, Fire Insuranceo Lessee is not obligated to provide fire insurance for the <br />Facility structure, but may obtain such insurance for personal property and fixtures to protect <br />against loss or damage by fire, vandalism and other such riskso The Facility is not covered by <br />earthquake insurance. <br /> <br />110 Insoectiono Lessee agrees that City, its agents and employees may enter the <br />Property, including the Facility, at any time to ensure that the Property is being properly <br />maintained and that the terms of this Agreement are being met and to comply ~ith the City's <br />obligations in Section 50 City may also post any notice on the Property required or permitted by <br />la~. <br /> <br />120 Comoliance ~ith La~so Lessee shall comply ~ith all federal, state and localla~s, <br />ordinances, rules and regulations that may pertain to the Property and Facility and its use. <br />Lessee shall not discriminate against any person or group of persons on account of race, color, <br />creed, religion, sex, marital status, ancestry or national origin or sexual orientation in the use of <br />the Facilityo <br /> <br />130 Assignment. Lessee shall not sublet nor assign any interest in the Property or <br />Facility ~ithout the City's approval. <br /> <br />140 Termination bv Citvo City may terminate this lease at any time for any reason by <br />serving upon Lessee a ~itten notice of its election so to terminateo Said notice shall be served at <br />least sixty (60) days prior to the day named in such notice for such terminationo City may <br />terminate the lease immediately if the premises are damaged to such a degree that, in the opinion <br />of the City Manager, continued use is not safe or feasible. Any holding over after the Term of <br />the Agreement shall be construed as a tenancy from month-to-month subject to the terms of this <br />Agreement so far as applicableo <br /> <br />150 Notices.
