<br />(a) Ovvners shall pay the then-existing se~er and ~ater connection fees for <br />connecting to the City se~er and ~ater system in accordance ~ith <br />applicable City ordinances and master fee scheduleso <br /> <br />(b) O~ers shall pay all costs associated ~ith extending the se~er and ~ater <br />system to serve the Exhibit A property, including any pro rata share cost <br />of the main line system, said system to be designed in accordance ~ith <br />City standards and subject to City approval. <br /> <br />c) Ovvners shall pay an amount computed in accordance ~ith the applicable <br />City formula for connection to se~er and ~ater facility improvements <br />subject to a mutual benefit district, reimbursement agreement, or any other <br />agreement 0 <br /> <br />(d) Ovvners shall pay a monthly se~er and vvater service charge as is no~ or <br />may hereafter be imposed once connection to the sevver or vvater system is <br />effectedo <br /> <br />(e) Because the City is required to apply to LAFCo for this extension, O~ners <br />shall pay the processing fees to LAFCoo <br /> <br />20 Agreement to Annexo O~ers consent to annex to the City of Pleasant on the <br />Exhibit A property at such time as City may require. This Agreement, State and County la~s, <br />and City ordinances and resolutions shall control the responsibilities of both parties at the time of <br />annexation 0 O~ners shall cooperate ~ith City in the annexation of the properties, ~hether as <br />part of a larger area or as part of a smaller area; O~ers expressly ~aive the right to protest said <br />annexation and shall agree to do no act calculated or tending to prevent, impede, or defeat the <br />successful annexation of the propertieso More specifically, by signing this Agreement, O~ers <br />ackno~ledge and agree that if any annexation is subject to an election, the O~ners deem that <br />their votes are counted as votes in favor of annexation if at the time of the election a road that is <br />intended to take golf course traffic off Alisal Street and Happy Valley Road is under construction <br />or has been constructedo <br /> <br />30 No Further Subdivisiono O~ers shall not subdivide the Exhibit A property <br />~ithout the prior approval of the City of Pleas an to no <br /> <br />40 Design Revie~ Approval. In the event that O~ers shall redevelop the Exhibit A <br />property, O~ners shall submit plans for the redevelopment of the Exhibit A property to the City <br />for the City's revie~ and approval. Assuming that the Exhibit A property is still in the <br />unincorporated area of Alameda County at the time O~ers intend to apply for a building permit <br />for the Exhibit A property, O~ers shall neither apply for nor obtain a building permit from the <br />County of Alameda unless and until City has approved the design of the plans for any proposed <br />redevelopment on the Exhibit A propertyo <br /> <br />50 Bonded Debto O~ners consent that, upon annexation of the properties to the City, <br />said properties shall be taxed to pay their share of existing bonded indebtedness of Cityo This <br /> <br />SR 06 008 Attachment <br /> <br />2 <br />
