WHEN RECORDED, RETURN TO: City of Pleasant on P.Oo Box 520 Pleasanton, CA 94566 PREANNEXATION AND PROVISION OF WATER AND SEWERAGE FACILITIES AND SERVICE AGREEMENT THIS AGREEMENT is made this 3rd day of January, 2006 be~een the City of Pleasanton, a municipal corporation (City) and Frank and Marie Silveira (O~ners)o RECITALS Ao O~ners are the o~ers of certain real property located at 849 Sycamore Road, Pleasanton, CA, more particularly described in Exhibit A (the Exhibit A property) and incorporated herein by referenceo Bo O~ners ~ish to connect the Exhibit A property to the City se~er system in order to eliminate the need to repair and reconstruct an existing septic tank and leach field systemo Co O~ners may ~ish to connect the Exhibit A property to the City ~ater system at a later time to eliminate reliance on an existing ~ater ~elL Do Generally, City policy requires property to be annexed prior to extending such City services as ~ater and se~er service. Eo O~ners are ~illing to annex the Exhibit A property either as part of a larger annexation or as part of a smaller annexation involving properties and other property contiguous to the Cityo Fo The public health, safety, and ~elfare of the City's residents are ~ell served by eliminating the need for ~ater ~ells and septic tanks and by connecting to the City's -water and se~er systemo G. City is -willing to extend its se~er and -water services only if there are assurances that the properties ~on't be further subdivided ~ithout approval of the Cityo NOW, THEREFORE, City and O~ers hereby agree as follo~s: 1.
