Mr. Swig advised that the heritage trees had been appraised, and the value of the trees <br />that would be removed were included in the exl-iibii written by Ralph Usterling <br />Consultants. The funds would be put into the Urban Forestry Fund. <br />Mr. Swig advised that with respect to the joint Chrisman/B rozo sky well, the PUD <br />established a method for having the Chrism alts stop using the well if ii is needed for <br />domestic purposes by the Brozoskys. The PUD condition described the parameters of the <br />concept to be developed at the time of the vesting tentative map. He noted that both the <br />Chrismans and the Brozo skys have agreed that it would be easier to use generic tennis of <br />when the well was capable of providing sufficient water, rather than trying to identify <br />flow rates, capacities, or height of water in the well. Mr_ Swift noted that there was still a <br />disagreement with respect to the use of the water, as noted in the alternative condition <br />that Mr. Bro zosky presented to the Planning Commission previously. Mr. Broz_osky had <br />suggested that the term "domestic use" he expanded to include watering livestock on his <br />property, as well as the landscape around the housc_ Mr. Swift noted that the previous <br />minutes did not have any conclusive definition of "domestic use," and believed that it <br />would he appropriate for the CommissionZ to define that tenri. <br />Staffs drag condition is based on a reciprocity of water use if water becomes scarce <br />within the well_ I£the Srozo skys used the water for animal husbandry or landscaping, the <br />Chrismans would have that opportunity as well. However, i£thc Brozoskys cease using <br />the water for those purposes, and used it only for household purposes, the Chrismans <br />would stop using the well water altogether, as required by the PUD. <br />In response to an inquiry by Commissioner Maas, Mr. Swift confirmed that if the well <br />water became scarce, the Chrismans would use City water so that the Brozoskys may use <br />the well water for domestic uses. <br />In response to an inquiry by Commissioner Maas, Mr_ Swift noted that scarcity was a <br />difficult term to define. I-Ie noted that Mr_ Brozosky and Mr. Happ were satisfied to use <br />the word "scarce." When a drought has been declared, it seemed reasonable to staff to <br />institute a new set o£ criteria for the well's use, based on the concept that while sufficient <br />water may be available early in the spring, it niay not be available later in the year. <br />A discussion o£the Brozoskys water uses ensued. <br />in response to an inquiry by Commissioner Maas, Mr. Swift confirmed that an existing <br />condition of the PUD that states that the tentative neap must determine the parameters for <br />how the Chrismans will stop using the well so that the Brozoskys may use it exclusively. <br />He noted that the debate between the parties and staff addressed the definition of <br />"domestic use," which was the language in the PUD condition. He added that the <br />Planning Commission would resolve the definition of "domestic use," as well as any <br />other paran-ieter for the Brozoskys' exclusive use of the well_ <br />PLANNING COMMISSION MINUTES July 9, 2003 Page 3 <br />
