Zoning for the <br />properties are Public and Institutional and Service C7orn mercial, respectively. The <br />Planning C=ommission will also consider a negative declaration prepared for the <br />prof ect_ <br />This item was continued. <br />c_ PUD-17c Oak Tree Farm -Phase III/ Currin Construction <br />Application for PUD development plan approval to subdivide an approximately <br />2.22-acre site containing three existing homes into three single-fancily residential <br />lots. The property is located at 8272 Sassafras Court "Coning for the property is <br />PUD-RDR/LDR (Planned Unit Developxrient-Rural Density Residential/ Low <br />Density Residential) District <br />Mr. Swig summarized the staff- report_ He described the background of the project, and <br />noted that the barn and the three small houses arc to he removed From the site. Conditions <br />would allow the house on Parcel 3 to rcnzain as a subdivision sales office; a protective <br />debris wall would be constructed to protect that use from potential movement by the <br />active landslide upslope from the residence. Each lot would be constructed farther away <br />from the active landslide_ <br />The three parcels are similar in size to the other three lots within the Oak Tree Farm <br />neighborhood. One of the property owners across the street had expressed interest in <br />building a house that would protect the privacy of a home they hope to build on an <br />adjacent vacant lot" The manner in which atwo-story house may be constructed on Parcel <br />1 has been described in the conditions. Staff recommended approval of this item subject <br />to the conditions o£ approval. <br />In response to an inquiry by Chairperson Arkin regarding disclosures, Mr. Swift advised <br />that potential buyers would be informed that the parcel were part of a geological hazard <br />abatement district, as are all of the lots in this subdivi sion_ <br />A discussion of the specii-ic purposes of a geological hazard abatement district ensued. <br />Commissioner Roberts advised that she niet with Mr. Currin and walked the property_ <br />She believed there was a method of dealing with these three lots differently in the <br />GEHAD because of the greater possibility of impact by a landslide_ <br />Mr. Swig noted that the discussions regarding that issue had not been finalized_ He noted <br />that condition would. be completed before the final map or parcel map would take place_ <br />T'he GEHAD engineer is working with the Currins to dctcnriine how that ~r~ight work" A <br />possible solution would make any damaged structures the responsibility of the <br />PLANNING COMMISSION MINUTES July 9, 2003 Page 1 1 <br />
