Chairperson Arkin would like the rrrotion to clarify that all references to at~y type of mitigation or data relative to California Splash not be considered part of this mitigated negative declaration. Commissioner Roberts moved to consider the mitigated negative declaration prepared by the East Bay Regional Park District; deem it adequate for considering the actions before the Commission, which is only to rezone and amend the General Plan; determine that those actions will not have a significant effect on the environment; find that the proposed General Plan Use Amendment is consistent with the goals and policies of the general plan; find that the proposed rezoning is consistent with the General Plan; and adopt resolutions recommending approval of cases YGPA-7 and PRZ-15 to the Caty Council. This mitigated negative declaration is strictly for the Amendments, and no finding is made regarding any particular use on the property. Commissioner Kemeny seconded the motion. He described the previous history of this use, and noted that following discussion with staff, Sh-Boorz-r would operaie the proposed teen dances as follows: Patrons would be limited to high school students age 14 through 1 8, holding a valid student identification card.
