THE PUBLIC HE AR_ING WAS CLOSED. <br />Chairperson Arkin would like the rrrotion to clarify that all references to at~y type of <br />mitigation or data relative to California Splash not be considered part of this mitigated <br />negative declaration. <br />Commissioner Roberts moved to consider the mitigated negative declaration <br />prepared by the East Bay Regional Park District; deem it adequate for considering <br />the actions before the Commission, which is only to rezone and amend the General <br />Plan; determine that those actions will not have a significant effect on the <br />environment; find that the proposed General Plan Use Amendment is consistent <br />with the goals and policies of the general plan; find that the proposed rezoning is <br />consistent with the General Plan; and adopt resolutions recommending approval of <br />cases YGPA-7 and PRZ-15 to the Caty Council. This mitigated negative declaration <br />is strictly for the Amendments, and no finding is made regarding any particular use <br />on the property. <br />Commissioner Kemeny seconded the motion. <br />ROLL CALL VOTE <br />AYES= Commissioners Arkin, Kemeny, Maas, and Roberts <br />NOES= None <br />ABS"PAIN: None <br />ABSENT: Commissioner Sullivan <br />IZcsol ution No. PC-2003-23 and PC-2004-24 were entered and adopted as motioned. <br />c. PCUP-85, Sh-Boom <br />Application for a conditional use permit to allow dances for teens Isom 7=00 p.m. <br />to 12:00 midnight on Sunday and Tuesday nights during the summer months <br />beginning in June and ending in September, and on three-day weclcends during <br />the school year. The dances would be held at Str-Boom located at 4825 Hopy and <br />Road in the Gateway Square stropping center. The subject property is zoned PUD <br />(Planned Unit Devclopment~ - I/C - O (Industrial/Corrrn~rercial and Office <br />District. <br />Mr_ lscrson summarized the staff report. He described the previous history of this use, <br />and noted that following discussion with staff, Sh-Boorz-r would operaie the proposed teen <br />dances as follows: <br />Patrons would be limited to high school students age 14 through 1 8, <br />holding a valid student identification card.
