cooperation among the neighbors regarding design was encouraged, and often enhanced <br />the overall appearance of the neighborhood_ <br />Commissioner Roberts noted that a plaaner from Escondido sent her their Historical <br />Preservation Code. <br />Commissioner Kemeny agreed with the desire to maintain the neighborhood flavor, but <br />added that the owners do have property rights to design the house as they wished. <br />Mr_ Iserson believed the contribution of a community amenity was a great idea, and may <br />fit best in the context of the Historic Preservation Ordinance. <br />Ms. Nerland advised that the amenity must be related to the problem being mitigated. <br />Commissioner Kemeny noted that the City of Berkeley had good information regarding <br />residential to commercial conversions. <br />Ms. Nerland noted that this was a guideline for staff and would not be as stringent as an <br />ordinance. <br />Commissioner Maas would like the design review process to consider a general <br />resemblance to the previous design. <br />A discussion about intentional neglect of homes ensued. <br />Ms. Nerland noted that it was difficult to compel homeowners to care about the <br />maintenance of their home, but that it was possible £or City staff to document instances of <br />neglect_ <br />Commissioner Roberts moved to adopt the Downtown °°50% Rule" as a guide to <br />staff for buildings of a historical nature, with the additions that: <br />1_ Th¢ appraiser should b¢ selected from a list co mpli¢d by the City; <br />2_ The appraiser shoo/d become familiar with the SO% Rule and oth¢r <br />information needed to perform this level of analysis; <br />3_ Staff is to separate int¢a~tional deferred maint¢nan ce from normal wear <br />and tear and to /ook for a way for the applicant to provide an appropriate <br />amenity to the community in cases of intentional deferred maint¢nanc¢_ <br />Commissioner Arkin seconded the motion_ <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Maas, Kemeny, Roberts, and Sedlak <br />NOES: None <br />ABSTAIN: None <br />ABSENT: Commissioner Sullivan <br />The motion carried. <br />PLANNING COMMISSION MINUTES April 9, 2003 Page 12 <br />
