Commissioner Maas moved to recommend approval of Case PUD-02-1D to the City <br />Council, per the conditions of the staff report, including best efforts to provide public <br />art to commemorate "9-11." <br />Commissioner Kameny seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Maas, Kameny, Roberts, and Sedlak <br />NOES= None <br />ABSTAIN. None <br />ABSENT= Commissioner Sullivan <br />Resolution No. PC-2003-10 was entered and adopted as motioned. <br />11. MATTERS FOR COMMISSION'S INFORMATION <br />a. Review of Residential Flagpole Regulations <br />Mr_ Iserson summarized the staff report, and reviewed the background of the issue; the <br />Commission had directed staff to prepare this review for it consideration. He noted that the <br />G'ity may not review any text or graphics on the flag, which was a First Amendment issue. <br />Mr. Iserson noted that staff issues included: <br />1. Height= most residential flagpoles are between 15 and 35 feet in height; <br />2. Setbacks= staff suggests that flagpoles be allowed in the front yard, since <br />they are oRen placed there. A five foot minimum front yard setback, £ve <br />foot side yard, and a fifteen foot rear yard setback is suggested; <br />3. Type and intensity of illumination: the photocell light should be no more <br />than 75 watts with automatic timing to be turned on between 4:30 p. m. and <br />10:00 p.m. They shall be ground-mounted to not shine on adjacent <br />properties- <br />4_ Flagpole diameter shall be no more than six inches; <br />5. A nylon hoist or a new flagpole design which does not require a hoist to <br />reduce noise- <br />G If the flagpole standards were codified, it would eliminate the design review <br />process. He noted that 99% of flags do not go through a design review <br />process, as is_ <br />Mr. Iserson recommended that the Comiriission discuss the issues and give staff direction- <br />Commissioner Maas moved to amend the existing flagpole regulations to allow a <br />resident to Have a flag in front yard. <br />Commissioner Sedlak seconded the motion. <br />Following Commissioner Maas' motion, Chairperson Arkin preferred that the Commission <br />continue discussion of the issue. <br />Commissioner Roberts suggested that a 30-foot height limit would be acceptable. <br />PLANNING COMMISSION MINUTES March 12, 2003 Page 17 <br />
