Commissioner Sullivan advised that he was happy with what staff brought back to the <br />Commission. He agreed that the mechanical drive issue should be examined more <br />thoroughly, and then brought before the Commission. He would rather see the Energy <br />Advisory Group work on bigger, more important issues. He did not wish to hold. the <br />ordinance up, and suggested that the mechanical drive issue be considered in an <br />amendment or another ordinance. <br />Ms. Eisenwinter preferred that the mechanical drive matter be brought back as an <br />amendment or a separate ordinance. Staff would like more time to research the issue, and <br />would like to have interested parties involved, such as representatives from the business <br />community and Chamber of Commerce, so that staff may receive more information. <br />Commissioner Sullivan noted that he was comfortable with staff s recommendations, <br />although he would like to see the noticing expanded with respect to this matter. He added <br />that the EAG had been very concerned with the noticing issue. <br />Ms. Nerland noted that from a legal standpoint, the noticing for generators went far beyond <br />the noticing requirements for other heavy industrial uses, which may have similar impacts- <br />In cases where a thousand notices may go out, a quarter page advertisement in the <br />newspaper may be sufficient. Staff did not want it to appear as though the ordinance was <br />treating these uses differently than other heavy industrial uses without a good reason to do <br />so. <br />In response to an inquiry by G'ommissioner Maas, Mr. Iserson replied that the Hacienda <br />Business Park may be the next project to which this ordinance may apply. <br />Commissioner Maas did not agree with the fact that residential, commercial, or retail <br />renters did not receive notices. She liked the idea of the newspaper advertisement because <br />it reached more affected people. <br />Commissioner Roberts suggested that the G'ity Council meeting, which is televised, would <br />be a good forum to address the future Planning Calendar. She believed that would be a <br />good way to notify the citizens who watched the City Council meetings, but did not <br />receive notices regarding Planning items. <br />Mr. Nerland noted that the 1 .5 mile noticing would be paid for by the applicant. <br />Commissioner Sullivan wished to discuss the [LAVMA] and mechanical drive pumps. He <br />inquired whether the City had legal authority over what they could or could not do there. <br />Ms. Nerland replied that the general rule is that local agencies, special districts, and joint <br />powers authority like LAVMA must abide by the City's Zoning and Building ordinances. <br />There are several major exemptions to zoning ordinances, such as the absolute exemption <br />for the location or construction of facilities for production, generation, storage, or <br />trap siriission of water, or for the production or generation of electrical energy.
