The Planning CJommission recessed. for a break at 8c25 p.m. <br />Chairperson Arkin reconvened the meeting at 8c30 p.m. <br />b_ YADR-552, Bart Price <br />Application for modifications to the design review approval for the expansion of <br />the existing residence and construction of an eight-foot high block wall located at <br />459 Adams Way_ Zoning for the property is R-1-6,500 Single-family Residential, <br />6,500 Square Foot Minimum Lot~_ <br />Continued indefinitely. <br />c_ YAP-43 (PADR-669, John Du~gat•) Appellants- James and Joanne Norman <br />Appeal of the Zoning Administrator's approval of an administrative design review <br />application to construct additions to the existing dwelling at 3573 Kings Canyon <br />Court consisting o£ 1J an approximately 33-square foot single-story addition on the <br />north side of the existing garage; 2J an approximately 382-square foot single-story <br />addition on the west ~front~, east gear), and north ~side~ elevations; and 3) an <br />approximately 669-square foot second-story addition above the existing garage and <br />family room- Zoning for the property is R-1-6,500 Single-family Residential, <br />6,500 Square Foot Minimum Loth. <br />Mr_ Iserson summarized the staff report, and noted this was the third application within the <br />past several years for additions to Mr_ Duggan's house. He noted that the main issue was a <br />history of neighborhood concerns with the applicant's very slow progress in completing <br />work on his home, resulting in the condition of the property. He advised that there were <br />issues with regard to the applicant not obtaining a building permit for some work <br />performed, the unsightly condition of the house and the property, and some unsafe <br />conditions as a result of improvements started on the house that were never completed_ <br />These issues led staff to condition the design review approval with reduced periods for the <br />expiration of the design review in order to motivate the applicant to complete the work and <br />to correct the unsafe conditions on the site- In October 2002, code enforcement began <br />compliance hearings on this property, which were cancelled when the applicant submitted <br />a new design review application. Staff wished to reach an agreement between the applicant <br />and the neighbors. <br />AL the last Zoning Administrator hearing of December 16, 2002, the applicant was riot <br />present, but two neighbors, including the appellant, were in attendance- The neighbors <br />reiterated their concerns that they had expressed during the last applications with regard to <br />the ongoing issues. At that hearing, the Zoning Administrator approved the application for <br />design review with a three month expiration date for the first phase first floor) of the <br />application, and a six month expiration for the second phase garage and second floor). <br />Other restrictions included the completion of the first floor before a building permit could <br />be issued for the second story; the front porch must be completed before the first floor <br />PLANNING COMMISSION MINUTES January 22, 2003 Page 10 <br />
