<br />Another exception "W'ould be as to a Lot designated Hillside/Open Space. In those instances, <br />once a map is approved that creates more than half the lots allocated to such Lot, then all <br />Specific Plan fees for that Lot (to the extent they haven't already been paid) are to be paid. <br /> <br />For example, assume a property o"W'ner has a Hillside/Open Space designated Lot that "W'ould <br />allo"W' four ne"W' buildable lots in addition to an existing residence. The property o"W'ner "W'ants to <br />create one ne"W' lot. The o"W'ner "W'ould pay the Specific Plan fees for the one ne"W' lot. (The <br />o"W'ner "W'ould also be required under the Specific Plan to connect the existing residence to the <br />shared infrastructure improvements and "W'ould pay a portion of the Fees relative to such <br />connection.) <br /> <br />Assume t"W'0 years later, the property o"W'ner "W'anted to create t"W'0 more buildable lots. The <br />o"W'ner "W'ould be required to pay Specific Plan fees for the three remaining buildable lots even <br />though only t"W'o "W'ere being created because, by reason of the second parcel map, more than half <br />of the lots allocated to the Lot "W'ould be created by the second map. <br /> <br />In addition, the amendment to Program #7 "W'ill clarifY that if a property o"W'ner "W'ith a vacant Lot <br />obtains a building permit for that Lot, the property o"W'ner "W'ill pay the Specific Plan fee. <br /> <br />2. Amendment to Finance Program # 8 <br /> <br />The amendment to Program #8 "W'ill provide that property o"W'ners "W'ith existing residences (and <br />potentially buildable lots) "W'ho connect to the "W'ater and se"W'er system but do not subdivide "W'ill <br />pay Specific Plan fees only for the existing home. If the o"W'ner connects to only one of the <br />utilities, the o"W'ner "W'ill pay that portion of the Specific Plan fee attributable to that particular <br />utility; the remainder of the fee for that home "W'ould be paid "W'hen the o"W'ner connects to the <br />other utility. <br /> <br />** <br /> <br />*** <br /> <br />*** <br /> <br />** <br /> <br />Although this Option may result in the City's receiving Specific Plan fees at a later time than in <br />Option 1, staff nevertheless continues to recommend this Option. We do so because most <br />property o"W'ners "W'ho "W'ill benefit by this Option have relatively fe"W' buildable lots. Staff is <br />concemed that if a property o"W'ner is faced "W'ith paying the fees for lots that are not intended to <br />be built upon in the near term, the property o"W'ner may decide not to subdivide in the near term, <br />thereby delaying the receipt of any of the fees until some uncertain date in the future. It could <br />also "W'ork a financial hardship on a property o"W'ner "W'ho "W'ants to develop just one or t"W'0 lots <br />(but "W'ould under Option 1 pay fees for four or five lots) as "W'ell as a hardship on a property <br />o"W'ner "W'ith an existing residence "W'ho "W'ants to connect to just "W'ater or se"W'er, but not both. <br /> <br />SR:05:340 <br />Page 6 <br />
