<br />in place at this location. The installed equipment W'ill consist of a small antenna mast and <br />structure and electrical W'iring. The Lease Agreement is comprised of six three-year terms for <br />a total of 18 years. City approval is required for each three-year term. The City may <br />terminate the Lease at any time if the equipment and service interferes unreasonably W'ith the <br />city's use of the property. The antenna support structures W'ill be deeded to the City at the <br />termination of the lease. <br /> <br />This facility is located in Alameda County and not W'ithin the boundary of the City of <br />Pleasanton. Ether Web NetW'ork W'as referred to the County Planning Department for approval <br />of this installation. That approval from the County is attached. The location is remote, and no <br />local residents W'ill be affected by this installation. The equipment W'ill not be noticeable from <br />the Valley floor. <br /> <br />The Federal Communications Commission (FCC) stipulates in W'ireless communications <br />regulation Part 15.247 and 15.407 (W'hich apply to the technology Ether Web NetW'ork is <br />using), that no more than one W'att (or +30dBm) can be emitted from any transmitter. <br />Generally, the output poW'er of the equipment in use at this location W'ill be at about 50 % of <br />this level, or an effective output of 0.5 watt (or + 27dBm). <br /> <br />LEASE PAYMENTS <br /> <br />Council has previously approved leases W'ith telecommunications companies for the installation <br />of antennas and equipment on City property. The City has determined the lease fee based on <br />its analysis of the impact the equipment will have on City facilities and a vendor's W'illingness <br />to pay the City. Due to the limited impact on City facilities, the Lease Agreement provides for <br />a monthly payment of $300. The monthly fee is renegotiable every three years as a condition <br />of approving one of the five three-year lease terms. <br /> <br />In addition to the monthly rental fee, Ether Web W'ill provide the City W'ith the equipment and <br />service necessary to install a security camera at a location selected by the City. The use of the <br />camera W'ill alloW' staff to monitor a City facility. In addition, the City W'ill receive one <br />W'ireless Internet connection at no cost and additional Internet connections at a price <br />discounted by 25 % from commercial pricing. <br /> <br />CONCLUSION <br /> <br />As property owner, the City has the right to lease public property. Staff believes the impacts <br />to Pleasanton residents and City operations are minimal, and there is a positive public service <br />provided as a result of the lease. Staff recommends that the City Council approve the attached <br />site lease W'ith Ether Web NetW'ork LLC for the City-oW'ned site, and authorize the City <br />Manager to execute the lease. <br /> <br />SR:05:246 <br />Page 2 of3 <br />
