<br />The subject annexation is contiguous to the City limits and is within the City's Urban Growth <br />Boundary. This annexation is a logical expansion of the City boundary and would allow <br />appropriate control for future development. <br />As to the detachments, there is no need to retain the .182 acres north of the right of way for <br />public purposes and the current landowner (Greenbriar Homes) cannot use the property for any <br />development purposes. (Greenbriar will process a lot line adjustment with Lonestar in order to <br />merge the acreage into Lonestar's other County property.) In that the Lonestar parcel north of <br />the realigned Vineyard Avenue is encumbered with a storm drain detention pond (that the City <br />maintains) and will continue to be used indefinitely for industrial purposes, and in recognition <br />that the City has agreed to initiate the detachment ofthis property, this item is before Council for <br />action. <br />Annexation/Detachment Procedures <br />As to the private properties, the owners have requested that their properties be <br />annexed/detached. City staff has reviewed their requests for compliance with the City's General <br />Plan and LAFCo's policies regarding annexation/detachment and concludes that they comply. <br />The surrounding property owners have been notified that this matter will be considered by the <br />City Council at its November 1 meeting. <br />In order for the annexation/detachment to proceed, the Council will need to adopt a resolution <br />formally initiating the annexation/detachment with LAFCo and agreeing to the exchange of <br />property taxes with Alameda County. <br />The annexation/detachment application is submitted to LAFCo staff for its review. Once <br />LAFCo staff is satisfied that all requirements have been completed, the matter is scheduled for a <br />public hearing for action by LAFCo. <br />LAFCo may approve the application with either revisions or conditions; it may also decide not <br />to approve the application. The annexation/detachment becomes effective when it is formally <br />recorded with Alameda County. <br />Recommendation <br />Staff recommends the Council adopt a resolution formally initiating the annexation/detachment <br />of the properties in question. With regard to the Lonestar parcel, the resolution will include <br />language asking LAFCo to impose as a condition of detachment that the County refer to the City <br />for review and comment any land use applications filed for that property. That notice will <br />provide the opportunity for the City and residents near the site to be heard on proposed uses of <br />the site. <br />SR:05:292 <br />Page 4 of 5 <br />
