or as otherwise acceptable to the Director of Building Inspection that the final <br />development plan is in conformance with the geotechnical report approved with the <br />project. <br /> <br />52. <br /> <br />The project developer shall arrange and pay for the geotechnical consultant to inspect <br />and approve all foundations, retaining walls, and drainage geotechnical aspects of <br />project construction. The consultant shall be present on site during grading and <br />excavation operations. The results of the inspections and the as-built conditions of the <br />project shall be certified in writing by the geotechnical consultant for conformance to <br />the approved plans and geotectmical report and submitted to the City Engineer and <br />Director of Building Inspection for review and approval prior to occupancy. <br /> <br />Building <br /> <br />53. <br /> <br />The plan check materials will be accepted only after the effective date of the project <br />approval (30 days from the City Council adoption of the ordinance), unless the <br />applicant submits a signed statement acknowledging that the plan check fees may be <br />forfeited in the event that the approval is overturned or the design is significantly <br />changed as a result of a lawsuit. In no case shall a building permit be issued prior to <br />the expiration of the 30-day effective period. <br /> <br />54. To initiate the building permit plan check process, the applicant shall submit the <br /> following: <br /> <br />a. Three (3) full-size sets of construction plans (wet-stamped and signed); <br />b. Two (2) sets of the necessary structural and Title 24 calculations; <br />c. Two (2) copies of a site specific soils report; <br />d. The completed Building Questionnaire; and <br />e. The necessary fees. <br /> <br />55. <br /> <br />The project developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. The type and amount of the fees shall be those in <br />effect at the time the building permit is issued. <br /> <br />56. All dwelling units in the development shall be constructed to meet Title 24 state energy <br /> requirements. <br /> <br />57. The project developer shall obtain all building and other applicable City permits for the <br /> project prior to the commencement of construction. <br /> <br /> <br />
