18. <br /> <br />19. <br /> <br />20. <br /> <br />21. <br /> <br />22. <br /> <br />The project developer shall provide a bond to the City guaranteeing the installation of all <br />common open space and recreational improvements, private streets, street trees, and all <br />common infrastructure improvements Shown on the approved development plan or oth- <br />erwise required as part of this development. The project developer shall provide an item- <br />ized cost estimate of said improvements, to be submitted with the bond, for the review <br />and approval the Planning Director prior to issuance of building permits. The bond shall <br />be returned to the project developer upon acceptance of said improvements by the Plan- <br />ning Director. <br /> <br />The height of the primary structure(s) covered by this PUD Development Plan approval <br />shall be surveyed and verified as being in conformance to the approved building height as <br />shown on Exhibit "A" or as otherwise conditioned. Said verification is the project devel- <br />oper's responsibility, shall be performed by a licensed land surveyor or civil engineer, and <br />shall be completed and provided to the Planning Department before the first framing or <br />structural inspection by the Building Department. <br /> <br />All windows facing the RMC Lonestar plant shall be dual paned. This detail shall be <br />shown on the building permit plan set submitted to the Planning Director for review and <br />approval before issuance of a building permit. The structures to be constructed on Lots <br />33 through 36 shall be sited so that a useable yard area is provided on the westerly sides <br />of the structures and that the structures themselves would function to shield the yards <br />from the noise of the RMC/Lonestar processing plant. <br /> <br />The final configuration of the two (2) streets within this project which will be extended to <br />serve the adjacent Berlogar, Chrisman, and Brozosky properties shall be subject to the <br />review and approval of the Planning Director with the review of the final map and subdi- <br />vision improvement plans. Slight modifications to the final configuration of the lots in <br />the Hahner subdivision adjoining these two streets may also be required to accommodate <br />any change in the final configuration of these streets. The intent of any changes to the <br />configuration of these streets is to facilitate a superior roadway alignment on, and grade <br />transition to, these three (3) steeper sites: Berlogar, Chrisman, and Brozosky properties. <br /> <br />This PUD Development Plan approval shall function as a conditional use permit for the <br />detached, second units located on Lots 3, 5, 7, 9 - 10, 13, 15, 18 - 20, and 23 - 26. The <br />following requirements shall apply: <br /> <br />Only one (1) residential unit on the subject property may be rented. The other unit <br />shall be owner-occupied. The dwelling's owner shall be signatory to any lease for <br />the second unit. The second unit shall be occupied by no more than two (2) adults, <br />although there shall be no limit on the number of children. The project developer <br />shall prepare a deed restriction to this effect for these lots and shall submit it to the <br />City Attorney for review and approval prior to recordation of the first final subdivi- <br />sion map. <br /> <br />PUD-O0-OI (City Council approval) Page 6 of 28 March 7, 2000 <br /> <br /> <br />
