EXHIBIT "B" <br />Conditions of Approval <br />Case PUD-04 <br />6088 Sunol Boulevard <br /> <br />PLANNING <br /> <br />° <br /> <br />° <br /> <br />Development shall be substantially as shown on the development plans and <br />colorboard, Exhibit "A", dated "Received January 11, 2001" on file with the <br />Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br /> <br />The applicants shall obtain all building and other applicable City permits for the <br />project prior to the commencement of construction. <br /> <br />The developer shall pay any and all fees to which the property may be subject prior <br />to issuance of building permits. The type and amount of the fees shall be those in <br />effect at the time the building permit is issued. <br /> <br />This PUD development plan approval shall lapse and shall become void 2 years <br />from the date of approval unless a building permit is issued and construction has <br />commenced and is diligently pursued toward completion or an extension has been <br />approved by the City. <br /> <br />Medical and dental uses shall be prohibited uses on the subject property. <br /> <br />If necessary, the property owner shall utilize parking management tools to ensure <br />that all parking for the office building is accommodated on-site. If determined by <br />the Planning Director that spillover parking is occurring on adjacent streets and/or <br />properties, the property owner shall take steps to reduce parking demand up to and <br />including adding more on-site parking spaces. <br /> <br />Prior to issuance of a building pemait, the applicants shall reimburse the North <br />Sycamore Specific Plan funding developer(s) for its pro rata share of the North <br />Sycamore Specific Plan capital improvements as stipulated by the North Sycamore <br />Specific Plan Finance Plan. <br /> <br /> <br />
