The in-lieu agreement shall be reviewed and <br />acted upon by the City Council. <br /> <br />Any future restaurant user that locates within the structure shall be required to keep its <br />kitchen door closed at all times. <br /> <br />Any restaurant facility located in this structure shall be equippcd at all timcs with filtering <br />devices to minimize odors and fumes. <br /> <br />Window' frame and sill designs and balcony rail designs shall be as shown on attachment <br />to Exhibit "A". Windows shall have four divided lights and shall have individual mul- <br />lions. The project developer shall incorporate these design rcvisions in the building per- <br />mit plan set submitted to the Planning Director for review and approval befbre issuance <br />of a building permit. <br /> <br />The project developer shall add a building accent color and shall change the building trim <br />color to provide greater "punch" and contrast from the main body color. Trim and accent <br />colors shall be submitted to the Planning Director for review and approval before issu- <br />ance of a building permit. <br /> <br />The project developer shall install hedge planting in the lmldscapc arca bctwccn the ex- <br />isting parking spaces and the former Southern Pacific Railroad fight-of-way. Said plant- <br />ing shall bc spaccd so that at maturity, a filly-percent (50%) overlap of the planting is <br />achieved. This change shall be shown on the final building permit plan set submitted to <br />the Phmning Director for review and approval before issuance of a building permit. <br /> <br />The project developer shall replace the existing light-polc and quartz-halogen light- <br />fixtures with poles/fixtures matching historical-style fixtures presently being used in the <br />parking area. If necessary. additional fixtures may be added to the parking area in order <br />to illuminate the parking in accordance with the standards of the City's security require- <br />ments. This change shall be shown on the final building pcrmit plml set submitted to the <br />Planning Director for review and approval before issuance of a building permit. <br /> <br /> <br />
