Funding contributions for the cities are <br />based on the percentage of hotel and motel rooms in each city. <br />In 2004, the CVB began investigating additional funding sources to support its tourism <br />promotions and marketing activities. The CVB identified a Tri-Valley Tourism Business <br />Improvement District (TVTBID), based on paid hotel (hereafter called lodging business) room <br />occupancies, as the best option largely because the source of funding is directly tied to tourism. <br />Additional reasons include increasingly tighter City budgets, a need to improve existing tourism <br />promotion and a desire to be more self-sufficient in tourism promotion. <br />The CVB has been working with a consultant, Downtown Resources, to guide the organization <br />through the development of the TVTBID, and is working to have the assessment district in place <br />in early 2006. The tourism business improvement district would be established for 5 years, and <br />would include lodging businesses with 35 rooms or more available for public occupancy in the <br />four Tri-Valley cities of Dublin, Livermore, Pleasanton and San Ramon. The business <br />improvement district requires a simple majority vote to be approved; to date, 20 (of 35) lodging <br />businesses representing more than 61.9% percent of the total voting strength are in favor of <br />establishing the TVTBlD and have signed petitions agreeing to the creation of the assessment <br />district. The voting strength for each lodging businesses is determined by the property's number <br />of rooms factored by occupancy rate (2004 occupancy figures will be used). <br />It was proposed that Pleasanton would be the lead agency in forming the district and administering <br />assessments for the TVTBlD. On September 6,2005 the City of Pleasant on adopted a Resolution <br />Requesting Consent to form the Tri-Valley Tourism Business Improvement District from the <br />Cities of Dublin, Livermore and San Ramon. Subsequently, the City Councils of Dublin, <br />Livermore and San Ramon have each adopted Resolutions Granting Consent to the City of <br />Pleasanton to form a tourism business improvement district. <br />DISCUSSION <br />Council is being asked to adopt the attached Resolution of Intention. If the Council adopts the <br />Resolution of Intent to form the tourism business improvement district, the affected lodging <br />businesses will be notified of the intended action. After the required 45-day notice period, on <br />December 6, 2005 the City of Pleasanton will hold a public hearing to solicit comments of support <br />or protest. Unless there is a majority protest vote (50% + 1), staff will recommend the Council <br />introduce an ordinance to establish the Tri-Valley Tourism Business Improvement District. A <br />second reading to adopt the ordinance will be heard at the January 3, 2006 Council meeting; <br />should the ordinance be adopted, the TVTBID will be effective as of February 2, 2006. The <br />ordinance specifies that the City of Pleasanton will enter into a contract with a non-profit <br />organization, presumably the CVB, to administer and manage the funds collected through the <br />TVTBID. Through that contract, the City can specify requirements relating to oversight of the <br />funds, including approval of an annual budget by the City Council(s) and/or the requirement of <br />periodic financial reports. This is the same relationship that the City of Pleasanton currently has <br />in place with for the BID managed by the Pleasanton Downtown Association. <br />SR:05:270 <br />Page 2 <br />
