<br />Doug Sutton wished to address the issue of property value and noted that in the last three years, <br />the value of their property has risen by 50 percent. He believed that the quality of the California <br />Distinguished Schools would also raise the property values; he didn't believe people should be <br />too concerned about their property values. <br />Patricia Sutton noted that she informed the neighbors that she did not take care of older children <br />and did not want to have up to eight children, She liked taking care of babies, and noted that the <br />licensing must allow up to 14 children by State law, She noted that she would not have <br />14 nine-year-old children, which would run counter to State law, She noted that she only <br />intended to add two children, <br />Commissioner Fox noted that if a daycare licensed for eight children had nine children in the <br />home during a State inspection, the operator would lose the daycare license. <br />Mrs. Sutton noted that she was very careful to adhere to State law. <br />In response to an inquiry by Commissioner Blank whether she would willing to voluntarily limit <br />the number of children to ten, Mrs. Sutton confirmed that she would, <br />THE PUBLIC HEARING WAS CLOSED. <br />In response to an inquiry by Chairperson Maas whether the City could impose a condition <br />limiting the number of children, Ms. Nerland confirmed that would not be possible and that State <br />law and definitions pre-empted City law, <br />In response to an inquiry by Commissioner Arkin whether the City would limit the number of <br />drop-offs and pick-ups per day, Ms. Decker replied that any condition must be enforceable to a <br />degree. She noted that would be very difficult to regulate. <br />Commissioner Fox advised that she lived within 300 feet of a large family daycare home that she <br />did not realize was there. <br />Commissioner Fox suggested that drop-off and pick-up traffic be directed so they enter the north <br />end of the street and that a map be distributed to the customers, She also suggested that a <br />condition be added that crying children be brought inside, She would like the City, rather than <br />the applicant, develop the good neighbor guidelines so it would be consistent with other <br />guidelines in the City. <br />In response to an inquiry by Commissioner Blank regarding the video taken by the neighbors, <br />Ms. Nerland replied that the police chief was concerned that the children's identities and <br />schedules could be shown in a public forum without the parents' consent.
