<br />large family daycare six months after operation, and to delete the condition encouraging the <br />applicant and neighbors to work together regarding the number of children in the daycare, by <br />taking the following actions: <br />1. Make the required use permit findings for PDUP-7 as written in the attached Planning <br />Commission staff report; <br />2. Adopt the draft resolution denying the appeal, thereby approving Case PDUP-7, subject <br />to the modified conditions listed in Exhibit "B." <br />SUMMARY <br />At issue is whether conditional use permit approval to expand Mrs. Sutton's small family home <br />day care for up to eight children into a large family home daycare for up to fourteen children <br />should be upheld. After a lengthy public hearing where neighbors expressed concerns over <br />increased traffic, parking and safety issues, noise, aesthetics, and decreased property values, the <br />Planning Commission approved the application (3-2 vote) with amended conditions of approval. <br />The Commission found that the large family daycare will have minimal impact on surrounding <br />properties, is compatible with the neighborhood, is appropriate with this site, and complies with <br />State law on large family home daycares. The application has been appealed by a neighbor, <br />Beverly Me Williams. In an effort to resolve the neighborhood issues, staff conducted a <br />neighborhood facilitation process with the applicants and several of the neighbors. Although the <br />process was positive in bringing the neighbors together to identifY issues and suggest solutions, <br />the end result was that a compromise acceptable to all parties was not achieved. Therefore, this <br />matter is being brought to the Council for its final determination. <br />Honorable Mayor and Members of the City Council: <br />BACKGROUND <br />Patricia Sutton, the owner and resident of 5574 Paseo Navarro, applied for a use permit to <br />expand the existing small family daycare for up to eight children that she currently operates out <br />of her home into a large family daycare for up to fourteen children. The impetus for the <br />expansion was to accommodate two of her existing clients that are pregnant. Both clients would <br />like to be able to send their children to the same daycare provider. <br />The Planning Commission reviewed and approved the application at its meeting of May 25, <br />2005 with the addition of two conditions of approval. The first requires that a meeting between <br />the appropriate City representative, the neighbors, and the applicants be held every 45 days of <br />the first year of operation to discuss traffic, parking, and noise issues.
