68. <br /> <br />69. <br /> <br />~ at the time a tentative map is reviewed and approved for these <br />lots. <br /> <br />(c) <br /> <br />UPRR Soundwalls. Property Owner shall be allowed to construct an eight-foot <br /> high soundwall on the east side of the UPILR railroad track right-of-way <br /> south of the Valley Avenue underpass, as shown on Figure 6-1, Noise <br /> Mitigation Measures Policy Diagram, of the Bernal Property Specific <br /> Plan. The soundwall on the east side of the railroad tracks may be <br /> constructed commensurate with any residential use within the Eastern <br /> Area. <br /> <br />Commercial Uses as a Noise Buffer. Commercial buildings shall provide noise <br />attenuation for residential uses in the northwestern portion of the Central Ama. Should <br />residential use within the Central Parcel occur prior to construction of the commercial <br />structures, development of such residential uses may proceed as scheduled, and noise <br />conditions shall be considered as an interim impact that does not require additional <br />mitigation. <br /> <br />Subsequent Noise Studies Required. Following construction of soundberms and <br />soundwalls as set forth in Condition 67, noise levels in certain portions of the Project are <br />projected to remain in excess of 65 dBA Ldn. In such areas, as shnwn in Figure 6-1, <br />Noise Mitigation Measures Policy Diagram, of the Bernal Property Specific Plan, the <br />following shall apply: <br /> <br />(a) <br /> <br />Residences with ambient noise levels of 65 dBA Ldn or higher following the <br />construction of noise attenuation barriers as shown in Figure 6-1 of the Bernal <br />Property Specific Plan shall use building construction techniques to :'educe noise <br />to the extent feasible, where outdoor use is a major consideration (e.g., backyards <br />in single-family residential areas and recreational areas in multi-family residential <br />areas), consistent with other Specific Plan goals. <br /> <br />(b) <br /> <br />Residences lha! abut the open space and that are affected by a roadway sound <br />source may be subject to ambient noise levels following construction of noise <br />atrenuation barriers without further extcrior noise mitigation as described above <br />being required. <br /> <br />(c) <br /> <br />For residential uses in areas where the noise source from a railroad (e.g., along the <br />UPRR tracks) exceeds a maximum train pass-by level of 75 dBA, interior noise <br />shall be limited to a maximum instantaneous noise level of S0 dBA in bedrooms <br />and 55 dBA in other rooms throu~a a combination of soundwall and building <br />construction techniques. <br /> <br />Conditions of Approval Page 42 of 49 Revised August 21,2000 <br /> <br /> <br />
