10. <br /> <br />This PUD Development Plan shall be of no fm'ther validity and the project developer <br />shall be required to submit the same or new development plan for City approval prior to <br />development of the site in the event that the project developer fails to record a final map <br />within three (3) years of the City Council's approval of the PUD Development Plan. <br /> <br />11. <br /> <br />'[he project developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval of this <br />case, and that the project developer agrees and acknowledges that building permit ap- <br />proval may be withheld if sewer capacity is found by the City not to be available. <br /> <br />12. <br /> <br />This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building permits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the project developer is participating in the program. Notwith- <br />standing the project developer's participation in such a program, the City may withhold <br />building permits if the City determines that sufficient water is not available ~at the time of <br />application of building permits. <br /> <br />Planning Requirements: <br /> <br />13. <br /> <br />Regarding the proposed dedication of Parcel "E" to the City as public park land; if ac- <br />cepted, Parcel "E" would be combined with the adjoining park acreage, Knoll Park, ac- <br />cepted in conjunction with the Preserve subdivision, if not accepted, Parcel "E" shall be <br />combined with Lot 12. The resolution of this issue shall be reflected in the tentative sub- <br />division map submittal. <br /> <br />14. <br /> <br />The project developer shall initiate discussion with representatives of the Preserve <br />Homeowners Association regarding annexing its project to The Preserve Homeowners <br />Association, including merging the common open space areas of this development with <br />the Preserve's open space areas. If the project developer is unable to annex to or other- <br />wise include the open space area as part of The Preserve's maintenance liability, a home- <br />owners association for this development shall be created. This issue shall be resolved be- <br />fore Planning Commission approval of the Temative Subdivision Map. <br /> <br />15. <br /> <br />All new house designs and additions to existing homes shall be subject to the design re- <br />view procedures outlined under Chapter 18.20 (Design Review) of the Pleasunton Mu- <br />nicipal Code and shall be subject to review by the Planning Commission. <br /> <br />16. <br /> <br />With the application for the tentative subdivision map, the project developer shall submit <br />a wildland £tre management plan for the common open space areas and for Lots 11 and <br />12 for review and approval by the Planning Commission. <br /> <br />Page 3 of 17 <br /> <br /> <br />
