12. This approval does not guarantee the availability of sufficient water to serve the <br /> project. The City shall withhold building permits for the project if at the time <br /> building permits are applied for, mandatory water rationing is in effect, unless the <br /> City has adopted a water offset program and unless the project developer is partici- <br /> pating in the program. Notwithstanding the project developer's participation in <br /> such a program, the City may withhold building permits if the City determines that <br /> sufficient water is not available at the time of application of building permits. <br /> <br />13. For Lot 10, any portion of the building projecting over the rear building pad line <br /> shall be designed as a front-to-back, downhill split-pad configuration. <br /> <br />14. Lots 10 through 12 shall be recon~gured per Exhibit "C". The open space area <br /> shall be incorporated with the open space area dedicated to the City. <br /> <br />15. The project developer shall record CC&R's at the time of recordation of the final <br /> map which shall create a property owners association for the development. The <br /> CC&R's shall be subject to the review and approval of the City Attorney prior to <br /> recordation of the final map. The property owners association shall be responsible <br /> for the following: <br /> <br /> a. Maintaining the shared driveway for Lots 6 through 9. <br /> <br /> b. Maintaining the landscape fire barrier to be located along the west side of the <br /> public street/private driveway opposite Lots 3 through 9 and along the south <br /> side of Lot 9. <br /> <br /> c. Maintaining the street trees located on private lots. <br /> <br /> The City shall be granted the fights and remedies of the association, but not the obliga- <br /> tion, to enforce the maintenance responsibilities of the property owners association. <br /> <br />16. The project's design guidelines shall be modified as follows: <br /> <br /> a. Two (2) twenty-four inch (24") box street trees shall be planted for each lot. <br /> <br /> b. Solid wood fencing is only permitted along the side yard property lines ten <br /> feet (10' 0") behind the front comer of the house to twenty feet (20' 0") be- <br /> hind the rear comer of the house but going no closer closer than fifty feet (50' <br /> 0") to the rear property line and in no case being located on a natural and/or <br /> graded slope bank. <br /> <br />PUD-99-07, TTK Partnership OctOber 20, 1999 <br />Final Conditions of Approval Page 3 off 13 <br /> <br /> <br />
