<br /> XTACHMENT 9 <br /> CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, ALAMEDA <br /> ORDINANCE NO. <br /> AN ORDINANCE APPROVING THE APPLICATION OF RON AND KIM <br /> WINTER FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED <br /> UNDER CASE PUD-37 <br /> WHEREAS, Ron and Kim Winter has applied for Planned Unit Development (PUD) <br /> development plan approval to rezone the property from RM-15 to <br /> PUD-HDR and to allow the construction of four single-family detached <br /> residences and two attached multi-family residential units located at <br /> 520 St. John St.; and <br /> WHEREAS, the City Council determined that there were no changes to the <br /> environmental circumstances and impacts from the time that it certified the <br /> Environmental Impact Report for the Downtown Specific Plan area in <br /> December 2004 that would affect the environmental document; and <br /> WHEREAS, the Council received the Planning Commission's recommendations for <br /> approval of development plan; and <br /> WHEREAS, a duly noticed public hearing was held on September 20,2005; and <br /> WHEREAS, the City Council finds that the development plan, building design, and site <br /> development standards are consistent with the General Plan, the Downtown <br /> Specific Plan, and the purposes of the PUD ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. Approves Case PUD-37, the application of Ron and Kim Winter for <br /> Planned Unit Development (PUD) development plan approval to rezone the <br /> property from RM-15 to PUD-HDR and to allow the construction of four <br /> single-family detached residences and two attached multi-family residential <br /> units located at 520 St. John St., subject to the conditions shown on <br /> Exhibit B, attached hereto and incorporated herein by this reference. <br />
