<br />velopment on the Chrisman property will be annexed into the association. No approval <br />of the existing association or its homeowners will be necessary to effectuate this annexa- <br />tion. The CC&Rs would be subject to the approval of the City Attorney's Office prior to <br />their recordation. <br /> <br />Staff notes that it is not uncommon for the construction of PUD development plans to be phased. <br />As proposed and conditioned, the Berlogar portion of PUD-05 would be self-sufficient in terms <br />of access, utilities, etc., and would provide utility "stubs" to the westerly side of the Chrisman <br />property. Except for the modifications covered by this application, all previous requirements <br />and conditions would remain in effect. Although the lots would become custom lots, a single <br />project developer would still be able to propose new house designs for the lots as a single appli- <br />cation. <br /> <br />Design Guidelines <br /> <br />The Vineyard Avenue Corridor Specific Plan contains general architectural and landscape de- <br />sign guidelines covering the Low Density Residential development sites. The applicants' pro- <br />posed design guidelines for the lots covered by this development plan are attached. Staff con- <br />siders the guidelines as an example requiring further development. As conditioned by the Plan- <br />ning Commission, revised design guidelines would be submitted for review and approval by the <br />Planning Commission before the application is made for the first lot. Staff and the applicant <br />concur with this requirement. <br /> <br />Miscellaneous <br /> <br />Issues pertaining to "Site Plan, Lotting Standards, and Circulation", "Homeowners Associa- <br />tion", "View Analyses", "Green Building Measures", "ConstructionlDemolition Waste", and <br />"Grading and Geotechnical Issues", are discussed in detail in the attached Planning Commission <br />staff report. <br /> <br />PUD DEVELOPMENT PLAN MAJOR MODIFICATION FINDINGS <br /> <br />The Zoning Ordinance of the Pleasanton Municipal Code sets forth the purposes of the Planned <br />Unit Development (PUD) District and the "considerations" to be addressed in reviewing a PUD <br />Development Plan. These considerations would also apply to a major modification of an ap- <br />proved development plan. The City Council must make the findings that the proposed modifica- <br />tion conforms to the purposes of the PUD District, listed in the attached Planning Commission <br />staff report, before taking action ofthe proposal. <br /> <br />PUBLIC COMMENT <br /> <br />Notices of the Planning Commission's public hearing on this item were sent to homeowners liv- <br />ing within 1000- feet of the project area and to all homeowners living within the Vineyard A ve- <br /> <br />SR:05:259 <br />Page 5 of7 <br />
