<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF FRANK AND <br />BARBARA BERLOGAR AND KENNETH AND PAMELA CHRISMAN <br />FOR PLANNED UNIT DEVELOPMENT MAJOR MODIFICATION, AS <br />FILED UNDER CASE PUD-05-1M <br /> <br />WHEREAS, Frank and Barbara Berlogar and Kenneth and Pamela Chrisman have <br />applied for a major modification to an approved Planned Unit <br />Development (PUD) development plan to replace the approved house <br />design plans on the Berlogar portion with design guidelines and to separate <br />development of the overall project into two phases; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low <br />Density Residential) District; and <br /> <br />WHEREAS, an environmental review for the proposed project was undertaken with the <br />Environmental Impact Report (EIR) for the Vineyard A venue Corridor <br />Specific Plan, certified by the City Council on June 1, 1999; and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances under <br />which the project is undertaken that involve new significant environmental <br />effects or substantially increase the severity of previously identified effects, <br />and there is no new information of substantial importance not known at the <br />time the EIR was certified regarding the projects or its effects, mitigation <br />measures, or alternatives; therefore, no additional environmental <br />documentation was prepared for this application; and <br /> <br />WHEREAS, at its meeting of August 10, 2005, the Planning Commission recommended <br />approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on September 20, 2005; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with <br />the General Plan policies and the purposes of the PUD ordinance of the <br />City of Pleasanton; and <br />
