Make the finding that the proposed modification of PUD-05 is covered by the Fi- <br />nal Environmental Impact Report (EIR) approved by the City Council for the <br />Vineyard Avenue Corridor Specific Plan; <br /> <br />2. Make the findings for the major modification of the approved PUD Development <br />Plan stated in the attached Planning Commission staff report; and, <br /> <br />3. Introduce the draft ordinance approving PUD-05-1M, subject to Exhibit "B", Draft <br />Conditions of Approval. <br /> <br />SUMMARY <br /> <br />The proposed project is the same as the previously approved development plan except for <br />enabling the Berlogar and Chrisman portions of the former development to proceed sepa- <br />rately from each other, replacing the previously approved house plans on the Berlogar <br />portion with design guidelines, and updating the previous requirements on green building <br />measures and construction/demolition waste recycling to present City standards. All <br />other aspects of the City Council's approval ofPUD-05 would remain effective. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />I. BACKGROUND <br /> <br />The applicants, Frank and Barbara Berlogar and Kenneth and Pamela Chrisman, have submitted <br />a request to modify PUD-05 to replace the approved house design plans on the Berlogar portion <br />_ Lots 11 through 19 - of PUD-05 with design guidelines and to separate the development of <br />PUD-05 into two phases according to ownership. The Chrisman portion of PUD-05 would still <br />use the building plans approved with PUD-05. Their application also includes other small <br />changes to the previous conditions, e.g., using the City's new green building and construction/ <br />demolition recycling conditions. The reason for the requested PUD modification is that the Ber- <br />logars are ready to complete the final approvals for their portion of the approved project whereas <br />the Chrismans are not. <br /> <br />Previous approvals on the Berlogar property are described in the attached Planning Commission <br />staff report. <br /> <br />II. SUBJECT PROPERTY <br /> <br />The Berlogar portion of the project site is a portion of the larger Berlogar property totaling 50.13 <br />acres. The Chrisman portion of the project site is a portion of the larger Chrisman property to- <br />taling 20 areas.
